PRE-TRIP INSPECTION

ADMINISTRATION
THE LAW - PART 396 FMCSA
(a) Every motor carrier, its officers, drivers, agents, representatives, and
employees directly concerned with the inspection or maintenance of commercial
motor vehicles must be knowledgeable of and comply with the rules of this part.

(b) Every intermodal equipment provider, its officers, agents, representatives, and
employees directly concerned with the inspection or maintenance of intermodal
equipment interchanged or offered for interchange to motor carriers must be
knowledgeable of and comply with the rules of this part.
396.3 Inspection, repair, and maintenance.

(a) General: Every motor carrier and intermodal equipment provider must
systematically inspect, repair, and maintain, or cause to be systematically inspected,
repaired, and maintained, all motor vehicles and intermodal equipment subject to its
control.
(1) Parts and accessories shall be in safe and proper operating condition at all times.
These include those specified in part 393 of this subchapter and any additional parts
and accessories which may affect safety of operation, including but not limited to,
frame and frame assemblies, suspension systems, axles and attaching parts, wheels
and rims, and steering systems.

(does not apply to a tow or dirve away business or business with only 1
passenger vehicle)

1.  System or process to receive reports of unsafe conditions or


equipment deficiencies
•  A method or way in which drivers can fill out and submit reports for
action and filing

1.  Program must address:
•  Brakes
•  Lighting devices, lamps, markers, signaling and alert devices
•  Wheels, rims, lugs and tires
•  Airline connections, hoses, and couplers
•  King pin upper coupling devices
•  Rails or support frames
•  Tie-down bolsters
•  Locking pins, clevises, clamps, or hooks
•  Sliders and sliding frame locks

Report for the repair and inspection process must include:


1.  Name of carrier responsible for the equipment
2.  USDOT and equipment number
3.  Damages and defects reported
4.  Affect on safety of operation
•  What the damaged item or piece does and how it effects safety
5.  Effect of damage or break down on the road
•  What happens on the road if the damaged item fails to work properly

Corrective Action:
1.  Deficiencies reported must be repaired
2.  The original report of damage/deficiencies must note/certify the
repairs made for each damaged item

Records must be retained for 3 months of the


original report
KEEP IN MIND
•  Drive more than one vehicle…must conduct an inspection and safety report
per vehicle
•  Must submit the inspection even if there are no shortfalls
•  If there are 2 drivers...one may sign if both agree
•  2 seperate reports
1.  Genral inspection report
•  May or may not identify damages
2.  Damage report
•  Specifically when the equipment needs repair
2 SEPARATE REPORTS

•  Both address the same parts •  One is an inspection

•  Other is a damage or ‘in need

•  The vehicle is safe to drive

•  Walk around the vehicle and point to or touch each item you
are inspecting

•  Inspect hoses for condition and leaks
