WHEREAS the Donor/Declarant above named is at the date of these present is a

sole and absolute owner, seized, possessed and otherwise well and sufficiently
entitled to all that piece and parcel of Bungalow (Ground + First Floor) on

AND WHEREAS the Donor/Declarant above-named, having fully seized and

possessed of and otherwise will and sufficiently entitled to all that aforesaid
property is his individual and personal capacity and full right to give, grant,
donate, gift and/or made a Hiba of the said property and the said property is free
from all liens, debts, burdens, charges, mortgages, encumbrances and disputes of
whatsoever nature.

AND WHEREAS the said owner MR. _________________ S/O

____________________, (Donor) in consideration of his natural love and
affection for his ________ MR. ________________ S/O ___________________,
(Donee) has voluntarily, in full senses, without duress, coercion, threat or pressure
of any kind has Gifted, Donated, Given his above said property to the Donee and
has made a Gift Deed.

AND WHEREAS, it is specifically mentioned herein that at the time of

Declaration of Oral Gift of the said property and so also at the time of
execution/registration of this Gift Deed, the Donor is not suffering from any sort
of disease such as weak eyesight or short of hearing or any sort of mental disorder
and or lack of memory, but in fact he is in his perfect health and condition with
sound mind has gifted the said property to the Donee only out of his natural love
and affection for his _______, the Donee.

NOW THEREFORE THIS DECLARATION OF ORAL GIFT OF

IMMOVABLE PROPERTY WITNESSETH AS FOLLOWS: -

1. That the Donor/Declarant above named, gifted, given, granted, donated and
made Hiba Bil Evaz of aforementioned property on ______________ by
way of pronouncement of oral gift one of love and affection for the
Donee/his _________ in the immediate presence of the two witnesses cited
above for specific purpose.

2. That at the time of pronouncement of oral gift the Donor has handed over
the physical possession of the said property along with all the documents
and receipts relating to the title of the said property to the Donee and the
Donee has taken over possession of the said property.

3. That the Donee has accepted the Gift of the said property described in the
schedule given below from the Donor and the Donee shall have the same
rights, which were enjoyed by the Donor in the said property.

4. That the Donor in order to avoid any misunderstanding, heart renderings,

controversies, conflicts and litigations if any, considered it necessary and
proper to expedite the registration of Oral Gift made and rendered it in
writing.

5. That the said gifted property is free from all sorts of encumbrances, liens,
charges, claims etc. of whatsoever nature till the date of its oral gift to the
Donee above named and the Donor has already by way of oral gift
transferred all his titles, claims and interests of the said property.

6. That from the day of oral gift the Donee is the absolute owner of the said
immovable property having possession of said property, all rights, titles and
claims whatsoever nature and shall be entitled to obtain necessary
Transfer / Mutation in the records of ______________ Co-operative
Housing Society Limited Karachi, Karachi Co-operative Housing Societies
Union Limited, Ministry of Housing and Works, Government of Pakistan,
Islamabad/Karachi and all the other Government and Semi-Government
Authorities at his sole discretion and in a manner as may be deem
necessary.

7. That henceforth the Donee shall be rightful and absolute owner of the said
gifted property and shall enjoy peacefully and have hold, occupy and
possess all the rights, titles and emoluments therein without any let, or
claim by the Donor or any other person or persons.

8. That the term and condition of this Deed of Confirmation of Declaration of

Oral Gift have fully been understood and admitted to be correct and binding
upon the parties without the chance for circumstances and repudiation.

ACCEPTANCE

_____________________, do hereby states on oath and accept the above said gift

as under:

1. That the Donor above named has pronounced the Oral Gift on

Society, Block _______, Karachi out of his natural love and affection in

pursuance of MUSLIM FAMILY LAW in presence of witnesses as

2. That I have accepted the Oral Gift on the ferry and have taken over the

actual physical possession constructive with absolute right take and interest

in the said gifted property and from the day of oral gift I am in possession

of the same without any hindrances or interference by the Donor or any

other person/persons. The alienation of the said property by way of oral gift

with possession has already been made in my favour.
