RE: SUBMISSION OF A PDF OF JUAN DELA CRUZ’S
EXHIBIT “4”

Defendant Juan dela Cruz, through counsel, respectfully states:

1. On 22 May 2021, the Defendant filed his Judicial Affidavit to


serve as his testimony on direct examination for the initial
presentation of Defendant’s evidence scheduled on 28 May 2021.

2. In his answers to question numbers 32 to 35 of his Judicial


Affidavit, the witness mentioned that he has a duplicate original
of the Deed of Absolute Sale. Such document was reserved for
marking as EXHIBIT “4”, with an undertaking to present the
original during an in-court hearing.

3. Unfortunately, through inadvertence, his counsel omitted to


submit a PDF of the duplicate original of the Deed of Absolute
Sale together with his Judicial Affidavit.

4. If only to enable the Plaintiff to cross-examine the witness, the


Defendant submits a scan of the Deed of Absolute Sale as Exhibit
“4.”
