Course Code: MLLAW1003C03 Course Title: Law and Justice in a Globalizing World

Attempt two questions from Part A and three questions from Part B.
All questions carry equal marks.

Part- A

1. According to Utilitarian thinkers the problem of common good and general


interest is also an important aspect of justice. They further opined that the aim of
justice is to provide ‘the greatest happiness of the greatest number’ or ‘the
greatest good of greatest number’. In the light of the above quoted lines discuss
the concept of justice as propounded by any two of the Utilitarian thinkers.

2. “Justice is that which makes man to live honestly not to injure any one and to
give everyone his due. Justice is not merely a fantasy but a necessary and
desirable goal of law and society. It is a term of synthesis.” In the light of above
quoted lines explain the Indian concept of Justice during Vedic, Buddhist,
Muslim, British and Post-independence period.

3. “Globalization is the spread of products, technology, information and jobs across
national borders and cultures. It describes an interdependence of nations around
the globe fostered through free trade. Globalization is a social, cultural, political
and legal phenomenon.” In the light of above quoted lines discuss the impact and
significance of globalization in context of justice. How globalization has brought
about economic development in our country? Discuss.

Part -B

4. “As per Aristotle, justice is a state of character which makes people to do what is
just and makes them act justly and wish for what is just. He further argued that,
justice is giving equal share to equal persons and unequal share to unequal
person”. In the light of above quoted lines explain the concept of justice as
propounded and developed by Aristotle.

5. How globalization is connected with administration of justice and discuss the
impact of globalization on Administration of justice.

6. “The World Trade Organization (WTO) is an international institution that
oversees the global trade rules between nations. It is based on agreements signed
by the majority of the world’s trading nations.” In the light of above quoted lines,
discuss the functions of World Trade Organization (WTO), as one of the
International Institutions, in shaping the global legal order in the world.

7. Briefly discuss your views about the steps which should be taken to establish a
just world order in which every nation shall have equal rights and status, in which
national sovereignty will be respected and peaceful resolution of international
issues will be made.
