SCHNEIDER, are the fee simple owners of that residential property located at 17685
Circle Pond Court, Boca Raton, Florida 33496-1002 ("Property"). The legal description

Records of Palm Beach County, Florida."

10. On July 28, 2006, the Defendant, LAURENCE S. SCHNEIDER, executed

and delivered a Credit Agreement for a 10-year Home Equity Line of Credit (HELOC) with

a credit limit of $1,500,000.00 and promised to pay any and all amounts borrowed from
the $1,500,000.00 Credit Agreement by making a single balloon payment on July 28,

2016. A true and correct copy of the Credit Agreement, which constitutes the Promissory

Note with respect to this credit transaction, is attached hereto and fully incorporated

the Credit Agreement (Exhibit "A") to FIRST AMERICAN BANK's predecessor in interest,

Bank of Coral Gables. The Mortgage was recorded on July 31, 2006 in Official Records

Book 20662 at Page 0250 of the Public Records of Palm Beach County, Florida. A true

and correct copy of the Mortgage is attached hereto and fully incorporated herein as

12. FIRST AMERICAN BANK is the entity entitled to enforce the Credit
Agreement and Mortgage under applicable law because of FIRST AMERICAN BANK's

merger with Bank of Coral Gables, which merger was effective on December 5, 2014.
Plaintiff, FIRST AMERICAN BANK, is the holder of the original Credit Agreement and
Mortgage.
13. The Property which is the subject matter of this foreclosure action is now

17. On or about March 31, 2016, in order to protect its security on the Property

being foreclosed herein, FIRST AMERICAN BANK advanced and paid Ad Valorem/real

property taxes for 2014 and 2015 in the amount of $46,148.17. FIRST AMERICAN BANK

may be required to make further and additional advances during the pendency of this
action to continue to preserve its security in the Property. Any and all such sums paid, or
paid in the future, are due and owing to FIRST AMERICAN BANK from the Defendant,
LAURENCE S. SCHNEIDER.

18. The Plaintiff, FIRST AMERICAN BANK, declares the full amount payable
under the Credit Agreement to be due because of (a) the Defendants, LAURENCE S.
SCHNEIDER and STEPHANIE L. SCHNEIDER's, failure to pay the Florida real property
taxes on the Property being foreclosed by April 1, 2016, (b) the Defendant, LAU REN CE
S. SCHNEIDER's, failure to make the monthly payment due on May 1, 2016 and all

subsequent payments and (c) the Defendant, LAURENCE S. SCHNEIDER's, failure to
pay the entire principal balloon balance which became due on July 28, 2016.

19. The Defendant, LAURENCE S. SCHNEIDER, owes the Plaintiff, FIRST

AMERICAN BANK, $1,488,748.05 in principal which was borrowed under the Credit

Agreement, interest on the unpaid principal amount from May 1, 2016, real estate
property taxes for the calendar years 2014 and 2015 in the amount of $46,148.17 and

represent it in this matter and is obligated to pay reasonable fees for services (including
