Guarantee
The equipment will be guaranteed against defective component design, workmanship and materials
for a period of (13) months from ship’s delivery to ship owner
This guarantee is based on the system being installed according to Sehong installation procedures.
Any parts replaced within the guarantee period will be replaced to FOB Pusan port free of charge.

The European Chemicals Agency (ECHA), in accordance with Article 95 of Regulation (EU) No
528/2012 concerning the making available on the market and use of biocidal products (Biocidal
Products Regulation), as amended by Regulation (EU) No 334/20141, has assessed your
submission for the purposes of inclusion on the list of active substances and suppliers (the
Article 95 list) for:

Applicant: KIST Europe Forschungsgesellschaft mbH, acting for Sehong

To support inclusion on the Article 95 list, on 06/07/2016 KIST Europe Forschungsgesellschaft

mbH submitted a Letter of Access (“LoA”) to a complete substance dossier in relation to a
relevant substance, as per the second subparagraph of Article 95(1) of the Biocidal Products
Regulation. The assessment of compliance with Article 95(1) of the Biocidal Products
Regulation was initiated on 13/07/2016 once the fee was paid.

The draft decision was sent on 14/07/2016 by ECHA for commenting within 1 month. The
Applicant did not submit any comments or additional information within the defined deadline.

In accordance with Article 95(1) of that Regulation, ECHA has taken the decision set out

1. Result of the assessment

The outcome of this assessment is that the application for inclusion in the Article 95 list is
approved.

2. Consequences of this decision

In accordance with Article 95(1) of the Biocidal Products Regulation, this decision supports
the inclusion of KIST Europe Forschungsgesellschaft mbH, acting for Sehong Co., Ltd. (Korea)
in the active substances and suppliers list (Article 95 list) published on ECHA’s website. The
Article 95 list is updated regularly.

As specified in Article 95(2), as of 1 September 2015, a biocidal product consisting of,

containing or generating a relevant substance, included in the Article 95 list, shall not be made
available on the market unless either the substance supplier or the product supplier is included
in this list for the product-type(s) to which the product belongs.

Explanatory Note

According to Article 95(1) of the Biocidal Products Regulation, ECHA is to publish a list of relevant substances and the respective substance and product suppliers. The relevant substances are the active substances, and all substances
generating an active substance, for which a dossier complying with Annex II to Biocidal Products Regulation or with Annex IIA or IVA to Directive 98/8/EC and, where relevant, Annex IIIA to that Directive (“the complete substance
dossier”) has been submitted and accepted or validated by a Member State in a procedure provided for by this Regulation or that Directive.
The suppliers (substance or product) are the persons who made the above-mentioned submission to a Member State or alternatively who make a submission to ECHA consisting of a complete substance dossier, a letter of access to a
complete substance dossier or a reference to a complete substance dossier for which all data protection periods have expired.
A substance supplier is an entity who manufactures or imports a relevant substance on its own or in biocidal products. A product supplier is an entity who manufactures or makes available on the market a biocidal product consisting,
containing or generating that relevant substance.
The purpose of this list is to “ensure the equal treatment of persons placing active substances on the market” (recital 8 of the Biocidal Products Regulation).
The list is structured per active substance and includes all product types (PTs), for which a submission has been made for the particular substance. In addition to this, the list includes the names of the entities (and the country from
their address), their role as substance supplier and/or product supplier and the date of inclusion of the entity in the list. The names of non-EU companies, who are either participants in the Review Programme or applicants under Article
95(1), are published together with their appointed EU-representatives (For Non-EU entities which have not yet appointed an EU representative there will be an indication).
The Article 95 list includes participants in the Review Programme (indicated in the list as RP Participant), supporters of new active substances, who have submitted a dossier under Article 11 of Directive 98/8/EC or under Article 7 of the
BPR (indicated in the list as New Active), submitters of product authorisation applications where the application includes an alternative active substance dossier (indicated in the list as Third Party Dossier), as well as suppliers who
submitted an application in accordance with Article 95(1) of the BPR and which has been found compliant by ECHA (indicated in the list as Art.95 submission).
Participants in the Review Programme and supporters of new active substances are indicated in the role of substance suppliers and/or product suppliers, as appropriate. Article 95(1) applicants are listed as substance suppliers and/or
product suppliers (depending on the information in their submission), and submitters of a ‘third party dossier’ are listed as product suppliers.
As specified in Article 95(2), as of 1 September 2015, a biocidal product consisting of, containing or generating a relevant substance, included in the Article 95 list, shall not be made available on the market unless either the substance
supplier or the product supplier is included in this list for the product-type(s) to which the product belongs.
The information on the list is accurate to the extent of ECHA’s knowledge as of the date of preparation of the list. If you would like to comment or send requests for modification of the list please submit the
request for corrections of entries on the Article 95 list available at the ECHA website.
