1 Mode of Submission of Tenders

Tenders should be submitted by email to the user


indicated in the Tender as Techno-commercial &
Price part. Details of Tenderer including contact
name, Phone no, GST etc.,

2 Techno-Commercial Part should contain the


following details: -

 Technical specification & Manufacturer’s


name
 Drawings & Technical Literature
 Other conditions, if any
 Overall Layout, individually indicating the
work to perform
 Technical Checklist attached with Technical
specification, if any duly filled & signed

3 Price Part should contain the following details:-

 Price Breakup of each item/ equipment, price


shall be Inclusive of spares, Charges for
Erection & commissioning, service Engineer,
Inspection charges, etc.,
 Cost of People including To& Fro, Boarding,
Lodging, Local Travel Expenses on Tenderer
 Price Bid is Door Delivery basis
 Standard Inspection charges is included in
Quote price
 Special Inspection required, on request basis
is chargeable extra from the Quote price

CAL reserves the right to alter and modify the scope
of supply at their discretion, consistent with the
policy of the Company and statutory bodies under
them as applicable to the contract from time to time.

5 DEVIATION LIST:

Materials/items offered shall confirm to CAL tender


specifications and information

Deviations if any in the Techno-commercial offer


from that of the tender enquiry should be clearly
furnished in a separate document titled as “ List of
Deviations”, failing which it will be considered that all
the terms and conditions are Accepted/Fulfilled.

6 OPTIONAL ITEMS:

Details of Optional items, if any, should be indicated


under separate heading in the technical bid and
respective price details should also be given in the
Price Bid.

7 After Submission of Quotation, NO unsolicited


correspondence will be entertained.

8 Tenderer will be Negotiated based on Market


Price/Competitor price if short listed.

9 Clarifications, either Technical or Commercial should


be submitted to points specifically and agreed in
writing before Finalization of Tender.

10 VALIDITY OF PRICE:

Prices should be valid for acceptance for a period of


6 months from the date of Submitting the Quotation.
Validity of the offer shall be extended if required
based on the request from CAL.

11 The Tenderer shall be prepared to depute his


representative to CAL, Pune for Techno commercial
Discussion during evaluation / finalization.

12 Craftsman Automation Limited, reserves to itself the


right to reject any tender at its discretion.

13 DUTIES AND TAXES:

Rates of GST (Goods and Service Tax) and other


taxes, if any, is Payable extra are to be indicated in
the Techno-commercial & Price Parts. In addition

the amount of tax and duties should be separately
shown in Price Part along with HSN Code and GST
Tax rate slab for the respective HSN Codes to be
indicated in the Offer

14 OFFER SUBMISSION TIMELINES:

Offer shall be submitted by or before 11th August


2018.

Tenderer may visit the plant any working day for


necessary site inspections, measurements etc which
may be necessary for them to prepare and submit
quote. Tenderer to submit necessary drawings of
their own based on the above along with the quote.
Any change from the above shall be carried out later
after award of PO only with the written consent from
CAL.

15 DELIVERY TIME: SUPPLY & COMMISSIONING

CAL would want the successful tenderer to complete


the entire work within 50 Days from the date of
award of LOI / Purchase order, whichever is earlier.

Delivery time for supplies and commissioning should


be Indicated in the Offer clearly with workings
hours/days & milestones to meet above requirement.

16 PAYMENT TERMS:

a. Supply of materials: CAL terms of payment is


100% payment within 45 days from the date
of erection & commissioning and Acceptance
by CAL representative.
b. In case of advance payment is sought, the
same has to be specifically indicated in the
Offer, and should not be more than 20% of
the Total value of the Bid.
c. Technical services: Technical services such
as installation, commission, training,
extended warranty/guarantee any shall be
payable after completion of each activities
against completion of station commission
certificate.

17 WARRANTY / GUARANTEE:

The Equipment/machinery supplied shall be


warrantied/guaranteed for satisfactory performance
for a period as specified in the tender enquiry

against faulty design, defective materials and poor
workmanship.

In case of any unsatisfactory performance/ failure


within the Warranty/Guarantee period, the supplier
should immediately rectify the failure by
repair/replacement of any such part found to be
under performing/ defective at his expenses.

Manufacturers test and Warranty certificates are to


be supplied along with the equipment’s’, wherever
applicable.

Extended Warranty / Guarantee charges on Annual


basis to be indicated in the offer beyond Agreed
warranty period

18 GOVERNING STANDARD:

All equipment should be commissioned as per Indian


Standard according to the location and local
governing Laws

19 SECRECY & RESTRICTION ON INFORMATION:

The information contained in the Enquiry


specification as such shall not be communicated to
any Third party without proper approval from CAL.

Information in respect of contracts/orders shall not


be released to the national or international media or
anyone not directly involved in this execution without
the written approval of CAL.

20 RISK PURCHASE:

If the supplier fails to supply the items ordered within


the delivery date or violate any of the terms and
conditions of the purchase order, CAL shall have the
following rights:
a. To terminate the contract with 15 days’
notice forfeiting the Advance Paid.
b. To initiate alternate procurement action at the
risk and cost of the supplier

21 SUB CONTRACTING AND ASSIGNMENT

a. Supplier shall not assign nor transfer the


Purchase Order nor shall any share or interest
therein in any manner or degree be transferred or
assigned by Supplier to a third party without prior
consent in writing of CAL Notwithstanding

assignment to which CAL has given consent,
Supplier shall be and remain solely responsible and
liable for the proper and timely execution of the
Equipment/ Machinery supply in accordance with the
provisions of the Purchase Order.

b. Supplier shall not contract with any subcontractor


and/or vendor without the prior written consent of
CAL. Such consent shall not relieve the Supplier
from any of his responsibilities and liabilities under
the Purchase Order. In addition, Supplier shall
ensure that the terms and conditions of any such
contract shall comply with and correspond to the
terms and conditions of the Purchase Order

22 INSPECTION, TESTING, INSTALLATION&


COMMISSION
Inspection & Testing at manufacturer’s Works

The equipment will be subjected to final test and


inspection attended by Third party inspection agency
Inspection Agencies.

Onsite Inspection

The supplier shall depute the required personnel to


assist CSL in carrying out installation of the
equipment/machinery onsite as per relevant clauses
of the Technical specification.

23 PRODUCT SUPPORT:

The supplier should provide product support for


equipment /sub assemblies/ components including
provision for periodic modular software upgrade if
any for the period mentioned in the Tender Technical
specification.

24 LEGAL RIGHTS:

The legal rights of the 'Buyer' viz. CAL involves


obtaining datal information, interface details from the
supplier wherever required. Request of clarification
and details/ information of technical nature sought
any over and above the quote is to be replied by the
supplier during the contract period.

SAFETY LABELS

Hazardous materials that require safety measures


for workmen involved in handling/ processing shall
bear safety labels showing procedures to be adopted
for safety.

26 SERVICE ENGINEER/TECHNICIAN ( for Other


Contract Tenders ):

Including Laying of Over Head Bend Pipe line for


Electricals to Machineries, Additional Pipe Laying
etc.,

PER DAY RATES

The per day rates quoted should be based on


the salary, allowance and other social benefits
normally payable to the individual in line with the
statutory norms and local by-laws. Other profit
elements should not be included. The rates quoted
should be valid for the entire calendar year and
escalation per year thereafter may be indicated
separately. The escalation sought should be based
on documents published by their
Governmental/Semi-Governmental authorities.
Overtime rate for work beyond normal working hours
should also be indicated.

WORKING HOURS

The per day rates quoted should be on the basis of


eight hours per working day at site, excluding
holidays. Working hours will be computed from the
time of reporting at site to the time of leaving the site.

SELECTION OF SERVIC ENGINEER/TECHNICIAN

Persons deputed should have the requisite technical


know- how/experience in trial and commissioning of
Equipments including all relevant systems and sub-
systems.

If it is found that the person deputed does not


possess the

requisite expertise/Knowledge, CAL reserves the


right to ask for a suitable replacement at the cost of
the supplier.

IT EXEMPTION

Supplier should depute only persons who are


entitled for exemption from income tax in India. In
case the supplier does not depute such persons,
the tax liability will be in the supplier's.

27 The tenderers shall give an undertaking that they


have not made any payment or illegal gratification to
any person/authority connected with the bid
process so as to influence the bid process and
have not committed any offence under the PC Act in
connection with the bid.

28 In a tender, either the Agent on behalf of the


Principal/OEM or Principal/OEM itself can bid but
both cannot bid simultaneously for the same
item/product in the same tender.

29 CAL reserves the right to place order to the


technically qualified lowest tenderer in full or
individual items to the respective lowest tenderers in
the tender.
