MOTION FOR DECLARATION OF DEFAULT

PLAINTIFF, through counsel, respectfully moves for an order


declaring the defendant in default in view of his failure to file his answer
within fifteen (15) days from date of service of summons which was duly
served on him on April 13, 2015. Hence, he already lost standing in court.

WHEREFORE, plaintiff prays that the defendant be declared in


default he having lost his standing in court. In addition, plaintiff requests
that he be allowed to present evidence before the Branch Clerk of this
Honorable Court after the latter is duly appointed to receive evidence ex
parte and judgment be rendered in favor of the plaintiff.

Plaintiff further prays for such other relief just and equitable under the
circumstances.
