17 Preliminary Provisions

19 Section 1. Title. This Implementing Rules and Regulations (IRR) is
20promulgated pursuant to Executive Order No. 110 dated 07 April 2020
21entitled: Institutionalizing the Comprehensive Social Benefits Program
22(CSBP). Accordingly, this IRR shall be known as the “IRR of Executive Order
23No. 110 also known as Institutionalizing the CSBP”.

25 Section 2. Statement of Policy. One of the strategies in attaining just
26and lasting peace in the Philippine Development Plan is to make the
27Government more responsive to peace, conflict, and security issues. This
28may be achieved by providing the Uniformed Personnel of the Armed Forces
29of the Philippines (AFP), including its Support Units consisting of Citizen
30Armed Force Geographical Unit (CAFGU) / CAFGU Active Auxiliary (CAA)
31Units, Philippine National Police (PNP), Philippine Coast Guard (PCG),
32Bureau of Jail Management and Penology (BJMP), and Bureau of Fire
33Protection (BFP), collectively referred to herein as Covered Personnel, the
34rightful and reasonable benefits in the performance of their sworn duties to
35defend and secure the State and to maintain peace and order.

37 Accordingly, there is a need to enhance and rationalize the existing
38assistance and benefits given to the Covered Personnel herein through a
39comprehensive social benefits program in recognition of their invaluable
40contributions to the pursuit of just and lasting peace.

42 Comprehensive Social Benefits Program (CSBP)

44 Section 3. The CSBP is hereby institutionalized as a mechanism to
45provide speedy, sustainable, and rationalized social benefits and assistance
46to the herein Covered Personnel who are killed or wounded in a legitimate
47action or operation sanctioned by the state, and their qualified beneficiaries.

49 Section 4. The CSBP shall provide for different types of benefits and
50assistance, such as but not limited to:
51 a. Special Financial Assistance;
52
53 b. Social Welfare Assistance;
54
55 c. Shelter Assistance;
56
57 d. Health and Medical Care Assistance;

59 e. Educational Assistance; and
60
61 f. Employment Assistance

66 Section 5. The CSBP shall cover Military and Police forces who are
67killed and wounded in legitimate action or operation sanctioned by the state,
68and their qualified beneficiaries. It shall also cover Other Uniformed Personnel
69who become casualties while in the performance of their respective duties in
70legitimate military or police operations, and their qualified beneficiaries.

73 Definition of Terms

75 Section 6. For purposes of this IRR, the following terms or words and
76phrases shall mean or be understood as follows:

78 a. Battle casualty – any active Covered Personnel who has been
79 declared dead, wounded, or injured as a result of legitimate
80 military and police operations

82 b. Beneficiary - refers to a dependent or survivor of a Covered
83 Personnel who is eligible to receive benefits, as follows:

85 i. Legal spouse of a married Covered Personnel, provided
86 that, if they are legally separated by a judicial decree, it is
87 not on grounds caused by or attributable to the receiving
88 spouse;
89
90 ii. Legitimate, acknowledged or adopted children: provided,
91 that except for children who by reason of their mental
92 incapacity are incapable of employment, entitlement to
93 herein benefits shall terminate when such children attain
94 twenty - one (21) years of age or get married;
95 iii. Parents of Covered Personnel or, if both parents are
96 deceased, unmarried siblings, grandparents or grandchild
97 of Covered Personnel in successive order; and
98
99 iv. Other beneficiaries qualified under existing laws, rules
100 and regulations such as a partner cohabiting with the
101 Covered Personnel concerned provided, there is no
102 impediment to marry each other.

104 c. Covered Personnel – refers to Personnel of the AFP, including
105 its Support Units consisting of CAFGU / CAA Units, PNP, PCG,
106 BJMP, and BFP.

108 d. Killed - in - Action (KIA) - refers to a Covered Personnel killed
109 in the line of duty in a legitimate military or combat operation,
110 disaster response, search and rescue activities and / or related
111 military action in support of police operations. This applies to
112 Personnel of the AFP including its Support Units consisting of
113 CAFGU / CAA Units.

115 e. Killed - in - Police - Operation (KIPO) - refers to a Covered
116 Personnel killed in legitimate police operation, disaster
117 response, search and rescue activities, and / or other related
118 law enforcement operations. This applies to Personnel of the
119 PNP, PCG, BJMP, and BFP.

121 f. Military Operation – military action in the carrying out of a
122 strategic, tactical, service, training or administrative mission.
123 This includes the process of carrying on combat, including
124 movement, supply, attack, defense, maneuvers needed to gain
125 the objectives of any battle or campaign, disaster response /

126 search, rescue activities and / or related action in support of
127 police operations
128 g. Other uniformed personnel – refers to the Personnel of the
129 PCG, BJMP, and BFP, and Support Units of the AFP consisting
130 of CAFGU / CAA Units.

132 h. Total Permanent Physical Disability (TPPD) - refers to the
133 anatomical loss or the permanent loss of use of one hand or
134 both hands, or one foot or loss of both feet or both legs, or one
135 eye or both eyes or both eyes having only light perception, or
136 mental faculties or impairment of a physical function immediately
137 resulting from the injury incurred during a legitimate combat
138 operation or related military or police operations, and which
139 renders such Covered Personnel indefinitely incapable of
140 substantially performing the mandated duties and functions of
141 that personnel’s position. This includes impairment of mental
142 faculties such as Post – Traumatic Stress Disorder and other
143 related mental illness.

145 i. Wounded - in - Action (WIA) - refers to a Covered Personnel
146 wounded in the line of duty in legitimate military or combat
147 operation or related military action in support of police
148 operations. This applies to Personnel of the AFP including its
149 Support Units consisting of CAFGU / CAA Units.

151 j. Wounded - in - Police - Operation (WIPO) - refers to a
152 Covered Personnel wounded in legitimate police operation,
153 disaster response, search and rescue activities, and / or other
154 related law enforcement operations. This applies to Personnel of
155 the PNP, PCG, BJMP, and BFP.

159 Components

161 Section 7. The following are the benefits and assistance to be provided
162under CSBP, subject to existing laws, rules, and regulations:

164 a. Special Financial Assistance (SFA) - A total amount of Five
165 Hundred Thousand Pesos (₱500,000.00) for KIA / KIPO
166 personnel shall be granted in two (2) tranches.
167
168 The first tranche shall be released upon receipt of the
169 complete documentary requirements by the Office of the

170 President (OP) - Office of the Deputy Secretary for Finance and
171 Administration (ODESFA).
172 The second tranche of the SFA shall only be released to
173 the beneficiaries after the completion of the free skill,
174 entrepreneurship and financial literacy training of Technical
175 Education and Skills Development Authority (TESDA),
176 Department of Trade and Industry (DTI), and Bangko Sentral ng
177 Pilipinas (BSP), Two Hundred Fifty Thousand Pesos
178 (₱250,000.00) for WIA / WIPO personnel with TPPD, and One
179 Hundred Thousand Pesos (₱100,000.00) for WIA/WIPO
180 personnel with Major and Minor injuries.

182 Consistent with their respective mandates, the following
183 Government Agencies shall provide the necessary and
184 appropriate assistance and support to the CSBP to effectively
185 provide the SFA provision:
186 i. OP - ODESFA shall expeditiously process and release
187 the first tranche of SFA, in the amount prescribed in the
188 Guidelines, and release the second tranche of SFA upon
189 the recommendation of the Department of Interior and
190 Local Government (DILG), after the completion of the free
191 skill, entrepreneurship and financial literacy training;
192 ii. DSWD , through its regional offices, shall conduct needs
193 assessment of the beneficiaries, provide social
194 preparation, assist in livelihood project identification and
195 project proposal preparation, and monitor and evaluate
196 the implementation of the project;
197 iii. TESDA shall provide appropriate skills training to WIA /
198 WIPO personnel and KIA / KIPO beneficiaries for gainful
199 employment and / or implementation of livelihood
200 projects;
201 iv. DTI, through its Negosyo Centers, shall conduct
202 entrepreneurship training programs for the beneficiaries
203 of KIA / KIPO and WIA / WIPO with TPPD personnel to
204 start a business enterprise, as well as to provide
205 assistance to improve and sustain existing livelihood
206 projects of beneficiaries; and
207 v. BSP shall provide financial literacy training to the
208 qualified beneficiaries of the KIA / KIPO and WIA / WIPO
209 with TPPD personnel

211 b. Social Welfare Assistance - Enrollment in the Pantawid
212 Pamilyang Pilipino Program - Modified Conditional Cash

213 Transfer under the DSWD or a monthly rice subsidy of twenty
214 (20) kilos or its cash equivalent based on prevailing market place
215 for those who will not be qualified in the Pantawid Pamilyang
216 Pilipino Program
217 c. Shelter assistance – Qualified beneficiaries shall be given the
218 following options for shelter assistance in coordination with the
219 National Housing Authority (NHA) of the Department of Human
220 Settlements and Urban Development (DHSUD) to wit:

222 i. Option A: Availment of Housing Units under the Old AFP
223 - PNP Program, subject to its availability;
224
225 ii. Option B: Availment of Housing Units under the NHA
226 Government Employees Housing Program with maximum
227 subsidy of Four Hundred Fifty Thousand Pesos
228 (₱450,000.00);
229
230 iii. Option C: Cash Assistance in the amount of Four
231 Hundred Fifty Thousand Pesos (₱450,000.00) for the
232 construction of a Housing Unit on the Existing and Owned
233 Lot of the beneficiary - family; and
234
235 iv. Option D: One Hundred Thousand Pesos (₱100,000.00)
236 Financial Assistance for the Repair / Rehabilitation /
237 Improvement of Existing Housing Unit owned by the
238 beneficiary

240 Consistent with their respective mandates, the following
241 Government Agencies / Units shall provide the necessary and
242 appropriate assistance and support to the CSBP to effectively
243 provide the Shelter Assistance:
244 i. Department of Public Works and Highways (DPWH),
245 through the endorsement of the DILG, shall assist the
246 NHA in the development of housing facilities through the
247 construction of access roads and bridges leading to NHA
248 Housing Sites, water resource projects and other public
249 works necessary for the development of the housing sites
250 to be livable for the CSBP Beneficiaries; and
251
252 ii. The Local Government Units (LGUs), through the
253 endorsement of the DILG, shall provide assistance in
254 water resource and electricity installation projects and
255 other works necessary for the housing site development
256

257 d. Health and Medical Care Assistance – The Department of
258 Health (DOH), together with Philippine Health Insurance
259 Corporation (PhilHealth) and OP - ODESFA, shall provide the
260 medical assistance for hospitalization and maintenance
261 medicines.
262 Consistent with their respective mandates, the following
263 government agencies shall provide the necessary and
264 appropriate assistance and support to the CSBP to effectively
265 provide the Health Care Assistance:

267 i. PhilHealth coverage of the beneficiaries of KIA / KIPO
268 beneficiaries shall be covered under the Universal
269 Healthcare Act of 2019. However, WIA / WIPO personnel
270 with TPPD and their beneficiaries shall be covered under
271 the R.A. 11228 (An Act Providing for the Mandatory
272 Philhealth Coverage for All Persons With Disability
273 (PWDs), Amending for the Purpose Republic Act No.
274 7277, as Amended, Otherwise Known as the “Magna
275 Carta for Persons With Disability”); and
276
277 ii. OP - ODESFA shall release funds for PhilHealth
278 premiums upon enrolment of qualified beneficiaries of
279 KIA / KIPO personnel
280
281 e. Educational Assistance - Educational Assistance to a
282 maximum of two (2) children or other qualified beneficiaries of
283 the KIA / KIPO personnel or WIA / WIPO personnel with TPPD
284 and provided further, that the said beneficiaries are not covered
285 by existing scholarship programs of the AFP - Educational
286 benefits Systems Office and the National Police Commission
287 (NAPOLCOM), and the Department of the National defense
288 (DND) - Commission of Higher Education (CHED) - Philippine
289 Association of State Colleges and Universities Study Grant
290 Program; and
291
292 f. Employment Assistance - Such reasonable assistance for the
293 employment of the beneficiary of the KIA / KIPO personnel and
294 WIA / WIPO personnel with TPPD to be facilitated by the DILG
295 with government agencies, such as but not limited to: AFP; PNP;
296 PCG; BFP; BJMP; DOH; DPWH; and Department of Education
297 (DepEd). Beneficiaries shall be qualified for Employment
298 Assistance only upon the vetting and endorsement of the DILG
299 to the concerned Government Agency for possible employment.
300 Successful applicants shall be employed on a Job Order,
301 Contract of Service or Permanent Appointment. Unsuccessful

302 applicants shall be endorsed back to the CSBP Secretariat for
303 placement to other employment opportunities and options. The
304 same shall be recommended by the DILG - Central Office to the
305 OP - ODESFA for proper representations with the Department of
306 Budget and Management (DBM) for identification of other
307 funding sources.

309 Section 8. The above benefits and assistance provided through the
310CSBP may be adjusted or modified based on the availability of funds, or upon
311the instruction of the President, as may be recommended by government
312agencies implementing the CSBP.

314 Section 9. Other forms of assistance provided by other Government
315Agencies, such as but not limited to: Welfare Subsidy; Skills Training on
316Financial Literacy and Entrepreneurship; and Livelihood and Employment
317Programs may still be availed by the qualified beneficiaries, subject to
318compliance with existing laws, rules, and regulations.

320 Section 10. The grant of the component benefits and assistance under
321the CSBP shall be uniform and equal in each type and application and shall
322ensure the most reasonable and rightful amount for each type of assistance.
323This order is not intended to, and does not create any right or benefit,
324substantive or procedural, enforceable at law, by any beneficiary against the
325national government, its department, agencies or entities, including its
326officers, employees, or agents.

329 Implementation Mechanism

331 Section 11. The DILG and DND shall jointly lead in the implementation
332of the CSBP. To ensure that prompt action is taken to efficiently and
333expeditiously deliver the package of assistance to Covered Personnel and
334their qualified beneficiaries, the DILG and DND shall coordinate and integrate
335the efforts of governments agencies such as, but not limited to: the DPWH;
336DepEd; DBM; Department of Labor and Employment (DOLE); DOH; DTI;
337DSWD; CHED; Department of Transportation (DOTr); TESDA; BSP; NHA;
338PhilHealth; NAPOLCOM; AFP; PNP; PCG; BJMP; and BFP.

340 Section 12. All Implementing Agencies / Offices shall streamline their
341issuances, orders, rules, and regulations governing access to the specific
342component benefit or assistance of the CSBP under their respective
343mandates. They shall ensure that the said issuances, orders, rules, and
344regulations, including Memorandum of Agreements between / among them,

345are consistent with this IRR and in accordance with relevant laws, rules, and
346regulations.
347 Section 13. Representatives of the Implementing Agencies / Offices at
348the National level, headed by the DILG and DND as Co – Chairpersons, shall
349conduct monthly meetings, or whenever deemed necessary, as Monitoring
350Committee.

352 They shall further monitor the compliance of the Implementing
353Agencies / Offices to their express mandate to ensure that their issuances,
354orders, rules, and regulations, including all Memorandum of Agreements
355between / among the said Agencies / Offices, are consistent with this IRR and
356such other relevant laws.

358 RULE VII
359 Regional Working Groups (RWGs)
360
361 Section 14. RWGs shall be created in each administrative region to
362assist the national government agencies in implementing the CSBP, through
363the effective and efficient delivery of the benefits to the beneficiaries at the
364local level.

366 Section 15. The RWG in each region shall be composed of the
367following:
368
369 a. Regional Directors of the DILG, DPWH, DepEd, DOLE, DOH,
370 DTI, DSWD, DOTr, CHED, TESDA, BSP, NHA, PhilHealth,
371 NAPOLCOM, PNP, BJMP, and BFP;
372
373 b. District Commanders of the Philippine Coast Guard with Area of
374 Responsibility over the concerned regions; and
375
376 c. Personnel officers of Unified Commands and other Major
377 Services of major units;
378 Section 16. The RWGs shall be headed by the Regional Director of
379the DILG as Chairperson. They shall conduct monthly meetings to coordinate
380their efforts, review progress in the implementation of this IRR, discuss
381identified implementation problem areas, and recommend activities or action
382plans to strengthen policies, systems, and practice.
383 They shall furnish to the Monitoring Committee, headed by the DILG
384and DND at the National level, their respective reports, findings,
385recommendations, and action plans they deem necessary for the
386improvement of the implementation of this IRR and success of the programs
387undertaken pursuant to the same.

394 Funding

396 Section 17. The funding for the implementation of this IRR shall be
397sourced from existing appropriations of the implementing agencies of the
398component benefits under the CSBP, such other appropriate funding sources
399as the DBM may identify, in coordination with the DILG and DND, subject to
400existing budgeting, accounting and auditing laws and regulations.

402 Funding requirements for the succeeding years shall be included in the
403respective budgets of government agencies implementing the CSBP.

406 Reportorial Requirement

408 Section 18. All concerned agencies shall submit biannual
409implementation and budget utilization reports on the status of the CSBP to the
410DILG and DND, with a copy to be furnished the Presidential Management
411Staff and the DBM.

413 The DILG and the DND shall ensure that the benefits and assistance
414under the CSBP reach the intended beneficiaries, monitor, and evaluate the
415effectiveness of program implementation, and submit to the Office of the
416President, through the Office of the Executive Secretary, an annual report on
417the implementation of this IRR.

420 Transitory Provisions

422 Section 19. All issuances, orders, rules, and regulations of the
423implementing Agencies / Offices, including all Memorandum of Agreements
424between / among the aforementioned, that are not inconsistent with this IRR
425shall remain valid and subsisting.

426 Covered Personnel shall enjoy the corresponding benefits and
427assistance provided herein from the date of the effectivity of Executive Order
428No. 110 on the 7th day of April 2020.

432 RULE XI
433 Final Provisions

435 Section 20. Rules of Interpretation. This IRR shall be liberally
436construed in favor of the Covered Personnel herein to institutionalize the
437CSBP and effectively implement the same.

439 Section 21. Separability. If any part or provision of this IRR shall be
440held unconstitutional or invalid, other parts or provisions hereof which are not
441affected shall continue to be in full force and effect.

443 Section 21. Repealing Clause. All other issuances inconsistent with
444this IRR are hereby repealed or modified accordingly.

446 Section 22. Effectivity Clause. This IRR shall take effect after fifteen
447(15) days following its publication in a newspaper of national circulation and a
448copy filed with the University of the Philippines Law Center.
