Italian road rules: driving license, principal violation, points,

documents, foreigners…

Regulations of the Road…the principal rules…for those that knows little Italian language.
The security of a person on a busy street is one main purpose of social and economic order. The
movement of the pedestrians, the vehicles and of the animals, on the street, is controlled by
norms, for the respect of international law. In order to obligate people to respect the laws, they
have to impose sanctions, administrative and penal and the deduction of points from the driver's
license, for those who do not respect the rules.
The points of the driving license.
With regards to points, every driver's license has at its disposition 20.
The points reduces each time that the driver violates one of the rules of comportment,

they can recover the points if from the last violation it passes two years without committing again
and always that the person did not reach the quarter zero.
For those who have acquired the driving license after 1st October 2003, if they commit
any infractions for the first three years, they will remove double of the points.
As one gets lost of its points, and to acquire the points back, at least 6, it requires attending
courses for recovering the points through the driving school.
* The cost of the fine is increased according to Article 195 (clause 2 bis) of the Highway Code
because the violation/transgression was committed after 10p.m. and before 7 a.m.
Payment within 5 days, 30% discount.
They have introduced a prize of good conduct for a driver that in two consecutive years has never
lost points; in fact, it is possible to obtain up to 10 points.

certificate for driving, can frequent the right
courses organized by the driving school. The

To drive a car, a motorcycle, or other vehicles

with engine, it occurs to have with you the
followings:

-A driving permit (driving booklet) containing

the technical data’s. We have to remember that
if we buy a new car after four years, we must

two years.

- Insurance:

- Driving license valid for the type of

vehicle that one is driving.

Lack of possessing the driving documents.
If you have forgotten the driving documents mentioned above at home
(euro 42,00), you must bring it in sight through a police organ before 15
days.

If you did not present yourself, it is punishable with

a sanction of 431,00 euro.

Moving with a driving license obtained from a foreign state, not European community.
-The driver free of a driving license, obtained from a foreign state, can drive in Italy, vehicles, in
which, their driving license is valid to for one year (1 year) of once residence, after one year of
their residence, they must convert their driving license.
If it is not possible to convert their driving license, they have to take the Italian driving license by
going through the driving school.
-If the driving license obtained from a foreign state is not conformed to the type established in
international convention, in which Italy has joined, they must forward an official translation in Italian
language.
-When one has demonstrated the possession of a qualified professional certificate, for the driving
of a determined vehicle, they must also have these documents.
-The driver free of a driving license, obtained from a foreign state they must respect all the
comportment laws and to those it is applicable the sanctions mentioned also for those having the
Italian driving license.
Conversion of a driving license obtained from a foreign state and from the states of
European community.
When the owner of a valid driving license obtained from a state of the European Economic
Community, takes a residence in Italy, to it, they have to apply the Italian way, in terms of the valid
duration of the driving license, of the medical checkups, of fiscal dispositions and of registration on
the driving license.
This includes also for the qualified professional certificate.
The owner of a driving license obtained from a state not a member of European community, if
there exist an international accord of reciprocity, they must instead convert their driving license.
The issuing of driving license, in substitution of the driving license from another state, warrants
thorough control of the psychical requisites, physical and morals.

FOREIGNERS.
Article 207 of the regulations of the road.
1. In case of violation of a norm of the regulations of the road, the driver in possession of a
driving license obtained from a state not being part of the European Union must show
immediately, in the hands of the responsible agent, the payment of the sanction.
In case the transgressor does not want to carry out the payment – for example, because he
wants to propose an appeal – must pay, always in the hands of the responsible agent, in the name
of caution, a sum equal to the double of the required sanction.
2. Failure to pay the caution comes with an administrative decision to stop the vehicle until
when it has not been fulfilled the foretold burden, however, for a period not more than
sixty days.
3. For the owner of a driving license, obtained from a foreign state in which they do not
follow, the system, the drivers’ license grading point, it is instituted through the
elaboration data centre for department of land transport of the ministry for infrastructure
and transports, a specific database.
4. This is progressively fed with anagraphic data’s of the drivers who have committed the
infraction, associating with each of them the point of penalization according to the
modality required from the regulations of the road.
5. For those who have committed, within the period of one year, has violated for a total
of, at least twenty points, the driving of a motor vehicles is inhibited on the Italian territory for a
period of two years.
6. Where the total is at least twenty points whether it has reached within an arc of two
years, the inhibition to the driver is limited to a year.
7. Where the total is at least twenty points whether it has reached in a period of time
comprising between two to three years, the inhibition to the driver is limited to a year.

CAUTION:
If you receive a report with ART. 126 BIS, you must communicate the data of the driver of the
vehicle, so that the items from the license will be subtracted\deducted.
If the data of the driver are NOT stated, there will be further fine of 292.00 euros.
Art. 126 bis is added when the police do not know the driver, for example in cases of parking in a
disabled-only area (art.158), or in case of minutes for Safety-speed (art.142.8°, art. 142.9 °), or for
T-Red (art.146 crossing with red light, etc.).
REMEMBER: all sanctions (all records) must be paid within 60 (sixty) days from notification (i.e.
after the police give an handwritten record with signature on, or when you get the record by mail
through a registered letter.
If the minutes (penalty) is not paid within 60 days, the fee (sanzione) gets double and is registered
in your tax form (o tax return).
