Jackson advised that earlier in the evening, she and her husband went to their home owners association meeting at Saint Francis Catholic Church, which is located at 4000 West Tidewater Lane, Madison, MS. Jackson advised that Ray Phelps assaulted her while she was at the meeting and wanted to press charges on him. | then had Jackson give me a verbal and written statement of the incident. Jackson advised that she attended the HOA meeting and after they paid their dues ($50.00), they tried to enter the meeting. Jackson stated that they and a few others were denied access to the meeting. Jackson stated that they were denied access because they didn't pay $150.00 in dues. Jackson stated that the HOA requires them to pay $150.00 a year in HOA dues. Jackson stated that they have paid $150.00 in dues for the past 4 years. Jackson stated that they recently they found out that their written covenants state that they are only supposed to pay $50.00 in HOA dues a year. Jackson stated that they refused to pay more than they should and that's one of the reasons they wouldn’t \et them in the meeting. Jackson went on to tell me that she and Phelps have a history due to a lawsuit. Jackson stated that Phelps and his wife don't like her due to her testifying in a lawsuit regarding the neighborhood. Jackson stated that she witnessed the HOA board let others into the meeting that hadn't paid their dues. Jackson stated that when she and others questioned Phelps, he got mad and told her she couldn't be recording with her phone. Jackson stated that she was in the hallway of the church outside the meeting room when this occurred. Jackson stated that Phelps attempted to grab her phone to take it away from her. Jackson stated that Phelps grabbed at her phone with his right hand. Jackson also stated that at the same time, Phelps also grabbed her right bicep and squeezed hard. Jackson stated that Phelps twisted her arm and then pushed her back up against the wall. Jackson stated that there were multiple witnesses to the assault Jackson stated that when Phelps grabbed her arm it caused her pain. Jackson stated that her back was hurting from where Phelps pushed her against the wall. Jackson stated that she had a red mark on her arm and bruise from where Phelps grabbed her. | observed reddening on Jackson's right bicep. | also observed two small bruises in the bend of Jackson right arm. | took pictures of the injuries and they will be included in the case file. Jackson stated that she videoed the incident with a cell phone. Jackson sent me the video to my Madison Police Department email. I received the video and reviewed it. The video will be downloaded and burned to a DVD and placed into evidence. On this date there were a few people that couldn't get in and they were pretty upset but only to the point where there was yelling and we asked them to keep it down or to go outside. There was a sign on the door that said no cell phones and no filming. There was a lady there by the name of Audrey Jackson who had her phone out and was filming the argument between the door person and another lady arguing, ‘There was a lady there that was about nine months pregnant and who hadn't paid her dues but they Iet her in and when asked how she got to come in they said the board approved it. At this point another argument started because they weren't aloud in and the other lady was. | was standing in the main hall way of the entrance that leads to another short hallway where the people were sitting who were letting people in that had paid there dues and not letting the ones in that hadn't. Aman later identified as Ray Phelps exited the meeting room into the short halll where Jackson was and | heard them getting loud again so | started making my way to the sounds of the argument when | heard someone say don't put your hands on her and then | heard Jackson say don't touch my phone. | saw Phelps in Jackson's face yelling at her and | told him to get back and not grab her phone which he did but everyone standing around was yelling at Phelps for apparently putting his hands on her. Phelps then went back into the meeting and the doors were locked. People were asking why we wouldn't arrest Phelps and | advised them because I wasn't going to arrest someone who | didn't see commit a crime and have that person sit in jail and the victim not come and sign charges, | told them that Jackson had the tight to file charges if she liked and | didn't fell Phelps was a flight risk so we would see if the Judge felt there was enough evidence to sign the warrant. Jackson was advised she could file charges if she liked but | didn't actually see what had happened. Jackson said she wanted to and Officer Kendrick provided Voluntary statements to the people who said they saw what had happened. Jackson exited the building and began making calls from her cell phone. Ray Phelps also stated that they had a list of people that could not enter the meeting due to not paying their home owners dues and being a good neighbor. | observed a sign on the meeting door that stated no phones and no filming, Iwas standing inside a side hall inside Saint Francis at the front entrance to the meeting room. There were people arguing that it was unfair that they could not get in because they paid their dues. The Home Owners Association let a pregnant lady inside the meeting that had not paid her dues and the people in the hall were very upset that she got in and they did not. Most of the people in the hall appeared to have phones out recording while they were arguing about winy they could not enter. | told everyone to calm down and looked down at my phone. I then heard screaming don't touch my phone in a female voice and you can't record in here in a male voice, At that time | looked up and observed a white male identified as Ray Phelps grabbing for Audrey Jackson's phone, Mr. Phelps had his open hand placed on Ms, Jackson's left arm in an attempt to grab her phone. Ms. Jackson appeared to be backing up. Mr. Phelps was told to back up and he did. Ms. Jackson stated that Mr. Phelps just assaulted her and wanted to press charges. | advised Ms. Jackson that she needed to go to the Madison Police Department to file charges because | did not witness the assault. Ms, Jackson did not state that she was hurt or injured at the time. Ms. Jackson stayed outside the church for a while before leaving. | obtained four written statements from individuals who were in the hall during the argument who stated they saw the incident. Donna McGarth stated that she was attending a meeting and wasn't allowed in. Ms, MeGarrh stated that she was speaking with Ray Phelps and Ms. Audrey Jackson was filming. Ms. McGarrh then stated “Ray Phelps basically rushed her, grabbed her wrists and tried to take her phone.” Ms. McGarrh stated that Mr. Phelps had her against the walll hollering at her. Debra L. Burrell stated that she witnessed Ray Phelps grab Ms. Jackson by the arm and shove her against the wall. Ms. Burrell then stated that her husband told Mr. Phelps to get his hands off Ms. Jackson. Ms. Burrell wrote that Ms. Jackson received a bruise on her left arm, but did not mention it to the police. Debra Shelby stated that several people were standing in the hall and Ms. Jackson was standing toward the back recording on her cell phone. Ms. Shelby then stated that Ray Phelps came towards her aggressively screaming that she could not video. Mr. Argrett stated that Mr. Phelps was yelling and being hostile towards Ms. Jackson. Mr. Argrett stated that Mr. Phelps did not was the details of the meeting recorded. Mr. Argrett then stated that he heard screarning so he turned around and saw Mr. Phelps grabbing Audrey and pushing her against the wall. Mr. Argrett told Mr. Phelps to stop and that there were too many witnesses and that he had gone too far. Mr. Argrett stated that Ms. Jackson was visibly upset and angry. Mr. Phelps stated that he was standing in the auditorium and noticed a "heated discussion" in the foyer. Mr. Phelps stated that five "troublemakers" were in front of his wife Judy Phelps. Mr. Phelps stated that he was concerned for his wife so he entered the foyer. Mr. Phelps stated one of the individuals in the foyer Mr. Argrett had threatened to kill him in the past. Mr. Phelps stated that as he entered the foyer he head "anger being expressed’, so he addressed the individuals. Mr. Phelps stated that everyone in the foyer had not payed their dues and were not allowed in the meeting. Mr. Phelps stated there was a sign on the door to the foyer stating no phones or recording devices and he noticed Audrey Jackson recording the event. Mr. Phelps stated he pointed out that it was against the rules. Mr. Phelps stated that Ms. Jackson did not stop recording so he tried to push her phone away. Mr. Phelps stated that she then moved the phone and "yes I touched her" and then someone poked him, Mr. Phelps stated at that point he asked the officer to remove everyone from the building, Ms. Phelps stated that she was sitting at a card table signing in eligible people for the HOA meeting. Ms. Phelps stated that the hallway was filled with angry people. Ms. Phelps stated that Ms. Jackson began filming the "ruckus". Ms. Phelps stated that at that time her husband Mr. Phelps stepped out of the meeting room and saw Ms. Jackson filming. Ms. Phelps said that Mr. Phelps then asked Ms. Jackson to stop recording and she would not. Ms. Phelps stated that Mr. Phelps reached for her phone and Ms. Jackson moved the phone away, causing Mr. Phelps to touch her hand. Ms. Phelps then stated Ms. Jackson started shouting "Don't touch me, don't touch me”. Ms. Phelps said that she then got between Ms. Jackson and Mr. Phelps saying "| don't want him touching you either’. Ms. Phelps said at that time the others that had gathered were all shouting and the Madison Police got everyone to calm down. The list of documents is as follows: 1. List of individuals Mrs. Jackson wants subpoenaed to the trial; including Wesley Jackson, Bobby Robinson, Purcy Burrell, Debra Burrell, Gus Argrett, Debra Shelby, Donna McGarrh, Officer Kendrick #412, Former Officer Magee #212, Sheriff's Deputy Thompson, and Officer Hall #385 2. Mrs. Jackson's medical report immediately following the assault 3. Copies of written voluntary statements previously given by Audrey Jackson 4. Notice of Annual Meeting given to Mrs. Jackson by the Natchez Trace Village (NTV) Home Owner's Association (HOA) before their meeting in 2019. 5. Copies of Certified Mail receipts for payments made to NTV Property Partners by Mrs, Jackson for HOA dues 6. Emaits showing supposed wrongdoing by the NTV HOA All documents have been enclosed in the case file. Mrs. Jackson also showed me pictures and video recordings on her phone showing a white SUV parked outside of Mrs, Jackson's residence that she believes belongs to Joe!
