AEIOU Financial E-Game Challenge (“GAME”), is developed for ALLIANCE BANK MALAYSIA BERHAD
(“ABMB”), legal address: Menara Multi Purpose, Capital Square, No. 8, Jalan M unshi Abdullah, 50100
Kuala Lumpur. SPARK CAPITAL DEVELOPMENT BERHAD (“SCDB”) is engaged in game development
and publishing and for good and valuable consideration set forth herein, makes available to you
(“Participant”) proprietary digital content: quiz, games and other interactive and/or educational content,
accessible through various platforms, including social networks, standalone application, web sites and
downloadable.

1. ACCEPTANCE OF TERMS AND CONDITIONS OF USE

1.1. Acceptance of this Terms and Conditions of Use creates a binding agreement between you and ABMB
(“Agreement”) and regulates the use of GAME, and other services, such as support systems (collectively,
our “Services”).

1.2. By installing the GAME or accessing the GAME through the social media platform, or downloading the
GAME from our systems such as AEIOU microsite (www.alliancebank.com.my/aeiou), you accept the
Terms and Conditions, which is incorporated herein by reference. Your relationship with ABMB will be
subjected to the Terms and Conditions and our Privacy Notice.

1.3. Binding agreement may also be concluded separately for any social media platform and thereafter provide
their own legal documents that apply to your relationship with these platforms.

1.4. The minimum requirement to participate in this GAME is 9 years and above. If you do not meet the age
requirement, you may play the GAME only if you have been granted proper consent by your parent(s) or
legal guardian(s) who are subject to the Terms and Conditions. Moreover, we may require an adequate
evidence of such consent at any time.

1.5. ABMB reserves the right at any time to modify the Terms and Conditions and Privacy Notice, and to
impose new or additional Terms and Conditions on your participation in the GAME. You should check the
AEIOU microsite for new versions periodically.

2. OWNERSHIP AND LICENSE

2.1. ABMB hereby grants you a non-exclusive, non-transferable, non-sub licensable, revocable limited license
to access the GAME and to download and install the desktop applications for this purpose, for your
educational use only, provided that you are in compliance with the Terms and Conditions. You are
conferring no title or ownership in the GAME; they are reserved, not sold to you. Your access is subject to
your prior acceptance of this Terms and Conditions. No portion of the Services may be reproduced in any
form or by any means, except as expressly permitted by ABMB. You agree not to modify, rent, lease, loan,
sell, distribute, publicly perform or display, transmit or otherwise communicate, adapt, publish the GAME in
any manner. Any attempt to do so is a violation of the intellectual property and other rights of ABMB and
SCDB. You may not use our trademarks, and any GAME content which includes, but not limited to artwork,
music, trade dress, or user generated content of others, without our prior written consent. The foregoing
grant of access shall be automatically revoked as of the moment that any of the foregoing conditions are
no longer met by you.

2.2. You may not copy, decompile, reverse-engineer, disassemble, attempt to derive the source code of the
GAME, modify, or create derivative works based on the GAME, any updates, or any part thereof.

2.3. Except for use of the GAME as permitted herein, any other use of GAME, or any respective parts is strictly
prohibited and infringes our intellectual property rights and may subject you to civil and criminal penalties,
including possible monetary damages.

 2.4. GAME is free to play, ABMB and/or SCDB have not provided any rights to any party to charge any fee to
participate in the GAME.

3. TECHNICAL AND SUPPORT

3.1. The minimum system requirements to operate the GAME are as follows:
 Operating System: Windows 10 32bit/64bit
 Processor Speed: 2.8GHz & above
 Memory: 128 MB
 Graphics Card: ATI Radeon 9800 w/ 256 MB video memory)
 Hard Disk Space: 2GB
 I/O Ports: USB port

Important Notice: You hereby expressly consent and acknowledge your responsibility for any internet
connection fees that you incur when accessing our services.

3.2. You may contact our SCDB support team through the options below for any assistance:

3.3. We aim to improve your usage experience and may add new or remove existing features and content of
the GAME, but we will only do so by taking into consideration and balancing users’ interest. For reasons
that include, without limitation, system security, stability, and multiplayer interoperability, we may need to
update, create new versions of or otherwise enhance the GAME and accordingly, the system requirements
to participate in the GAME may change over time.

3.4. You understand that graphical interfaces may not be consistent across all platforms and that the
performance of our GAME may vary, depending on your computer and other equipment.

3.5. Maintenance may affect availability of the GAME in social media platform, and will only happen in due
consideration of users’ interest. Downtimes may also be caused by technical problems beyond our control.

4. TERMS AND CONDITIONS OF THE GAME

4.1. The GAME shall run from 1 September 2019 to 20 October 2019 (both dates inclusive).

4.2. This contest is open to all Malaysian students from Primary 4, 5 and 6.

4.3. Participants who are directly related to the working committees of AEIOU, judges or their organising
partners are not eligible to participate in this GAME.

4.4. All participants are required to complete the on-screen player’s particulars before taking part in the GAME.
Only the duly completed player’s particulars such as name, age and school name will be accepted to
participate.

4.5. Each participant may participate multiple times.

4.6. Teachers are to submit the full participation list as downloaded from the GAME NO LATER than 5.00 p.m.
on Monday, 28 October 2019 to the following email: [email protected].

 4.7. The top fifty (50) participants from each school who qualify to the semi-finals will be notified through their
respective school.

4.8. Any entry which does not comply with any of the Terms and Conditions herein will be disqualified
automatically, without prior notification.

4.9. By participating in this GAME, the participants shall be deemed to have granted ABMB the exclusive
permission to use their names, photographs, voices, and likeness in connection with this GAME.

4.10. Prizes for the winners are as follows:

 The Grand Prize winner will receive RM3,000 in cash, a trophy and a certificate.
 The Second Prize winner will receive RM2,000 in cash, a trophy and a certificate.
 The Third Prize winner will receive RM1,000 in cash, a trophy and a certificate.

4.11. All winners will receive their prizes during the prize giving ceremony (“Awards Ceremony”). The exact date
of the Awards Ceremony will be communicated to the shortlisted participants later.

4.12. By participating in the GAME, the participants shall be deemed to have read, fully understood, agreed and
accepted the Terms and Conditions contained herein and shall be bound by the same.

4.13. Health Warning - certain people may experience a seizure while watching certain monitor images,
including flashing lights or patterns that may appear while playing GAME. Even people who have no
history of seizures or epilepsy may have an undiagnosed condition that can cause photosensitive epileptic
seizures while playing video games. These seizures may have a variety of symptoms, including light-
headedness, dizziness, altered vision, eye or face twitching, jerking or shaking of arms or legs,
disorientation, confusion, or momentary loss of awareness, loss of consciousness, involuntary movement
or convulsion. Please IMMEDIATELY stop playing and consult a doctor, if you experience any of these
symptoms. Please also note that when playing the GAME you should take certain standard health and
safety precautions, including avoiding playing when tired and drowsy, taking 10 to 15 minute breaks every
hour, sitting at a reasonable distance from the screen in a well-lit environment.

5. GENERAL

5.1. By participating in this GAME, participants are deemed to have read, understand and unequivocally
accepted and agreed to be bound by the Terms and Conditions herein (“GAME Terms and Conditions”)
including any amendments or variations to it and unequivocally accept the same in its entirety. The GAME
Terms and Conditions and ABMB decision on all matters relating to this GAME shall be final and binding
on all the Participants and no correspondence and/or appeal in respect thereof shall be entertained.

5.2. The Participants hereby give their unequivocal and irrevocable consent and authorise ABMB to disclose
their particulars to any third party service provider engaged by ABMB for the purpose of this GAME.

5.3. By participating in this GAME, the participants agree that all entries shall belong to ABMB. ABMB can
choose to use the entry in any manner it may deem fit at its absolute discretion in any of its promotional or
educational activities with prior notification to the participants.

5.4. ABMB shall not be responsible for any technical failures of any kind, whatsoever intervention, interruption,
electronic error and/or any failure or delay in the transmission of evidence by postal or telecommunication
authorities or any other party which may affect the Participants entitlement during the GAME period.

5.5. The participants hereby give their unequivocal and irrevocable consent and authorise ABMB to use,
publish and/or display the names, any photographs taken, any videos recorded and/or other information for
current and future advertising and/or promotion purposes in any manner it deems appropriate without any
compensation.

5.6. ABMB reserves the right to withdraw/cancel, terminate, suspend or extend this GAME and to add, delete,
suspend or vary the GAME Terms and Conditions contained herein, wholly or in part at its absolute
discretion with prior notice by way of posting on ABMB’s website, display at branch premises or
advertisements or by any other means of notification which ABMB may select and such shall be binding on
the Participants as from the date of the notification or from such other date as may be specified by ABMB
in the notification. Participants agree to access ABMB’s website at regular intervals to view the GAME
Terms and Conditions and are deemed to have agreed with any addition, deletion, suspension or variation
to the GAME Terms and Conditions.

5.7. ABMB reserves the right to disqualify the participation of any Participants or forfeit the GAME Prizes
“GAME Terms and Conditions Clause 4.10” in circumstances where there is a fraudulent, unauthorised or
reversal of transactions or breach or potential breach of the GAME Terms and Conditions at its discretion.
All records of ABMB on the transactions made shall be deemed conclusive and final.

5.8. For the avoidance of doubt, any cancellation, termination, suspension or extension of this GAME or
disqualification of Participants or forfeiture of the GAME Prizes “GAME Terms and Conditions Clause 4.10”
shall not entitle the Participants to any claims or compensations against ABMB or for any and all losses or
damages suffered or incurred by the Participants as a direct or indirect result of the act of cancellation,
termination, suspension, extension, disqualification or forfeiture.

5.9. ABMB shall not be responsible nor shall accept any liabilities of whatsoever nature howsoever arising or
suffered by Participants resulting directly or indirectly from this GAME. ABMB shall not be or held
responsible to the Participants in any manner whatsoever if ABMB is unable to perform any of its
obligations under this GAME directly or indirectly due to any force majeure event which include but not
limited to any act of God, war, strike, riot, industrial dispute, lockout, fire, drought, food, storm or any event
beyond the reasonable control of ABMB.

5.10. The eligible Participant shall be personally responsible for all taxes, rates, government fees or any other
charges that may be levied against them under applicable laws, if any, in relation to this GAME.

5.11. The GAME Terms and Conditions shall be governed by and construed in accordance with the laws of
Malaysia and the Participants agree to submit to the exclusive jurisdiction of the Courts of Malaysia.
