ADVISORY COUNCIL FOR PRICE REGULATION


RESOLUTION NO. 2009-004

IMPLEMENTING THE VOLUNTARY PRICE REDUCTION FOR AT LEAST SIXTEEN (16)


MOLECULES (OR 41 DRUG PREPARATIONS)

WHEREAS, access to affordable medicines for diseases of public health importance is


critical to improve the health and productivity of Filipinos, prevent impoverishment of
families
due to high cost of health care and thereby achieve the Millennium Development Goals and
National Objectives for Health:

WHEREAS, Republic Act $502 otherwise known as “The Universally Accessible Cheaper
and Quality Medicines Act of 2008" under Chapter 3 Section 17 and its implementing rules
and requiations provide that the President of the Philippines, upon recommendation of the
Secretary of the Departmnent of Health, shall have the power to impose Maximum Drug
Retall Prices (MRP) over any or all drugs and medicines as enumerated and provided for
within the Law

WHEREAS, as an outcome of the July 8, 2009 meeting of the President of the Philippines
with the representatives of the various multinational pharmaceutical companies, wherein Her
Excellency directed thasa companies to submit their voluntary compliance Letter of
Undertaking (LOU) within ten (10) days. 16 molecules (SKUs/preparations} from 8 innovator
companies and 1 local distributor (for products with no innovators locally}, have complied in
lowering the prices by 50%. upon submission of affected companies of their LOUs within the
prescribed period;

WHEREAS, Millennium Develapment Goal No. 8 aims ta develop a global partnership for
development, specifically Target 4 ln cooperation with pharmaceutical companies, provide
access to alfardable essential drugs in developing countries;
NOW WHEREFORE, in. order to implement voluntary reduction commitments by
pharmaceutical companies starting August 15, 2009, the Advisory Council endorses the
following agreements for the Secretary of Health's approval:

1. Manufacturers/distributors shall be voluntarily reducing prices of 16 molecules by


50% come August 15, 2009.
2. A letter of assurance shall be given by companies to drugstores for price adjustment
to enforce said reduction,
3. The drugstores shall reflect this voluntary 50% price reduction starting August 15,
2009.
4. The Bureau of Food and Drugs (BFAD) shall formulate an Administrative Order that
will reflect penalties and sanctions to vialators of this agreernent.
®. For small and medium sized drugstores that have manual systems and where said
price reduction is impossible to implement by August 15, 2009, they should comply
on or before September 15, 2009. Failure to do so by this date will mean sanctions
may be imposed starting September 16, 2009 subject to the policies formulated in
this regard by the Bureau of Food and Drugs (BFAD).
Be it, resolved and approvedto. transmit. this. Advisory Council Resolution for the
approval of the Secretaryof Health.
