SYNOPSIS AND LIST OF DATES

That the present petition is being filed by the petitioner herein for that the
petitioner is aggrieved by the act of the concerned authorities in the Uttar
prdesh Judicial Examinations held on 28th july, 2018. The bone of contention
is that as per the Answer key declared on 28thAugust, 2018 a total of 12
questions were wrong i.e. the questions stated were wrong. No compensation
for the above mentioned questions was given which meant deduction of marks
from the paper. This wrongful deduction led to the rejection of the petitioner
from the judicial examinations by 3 marks, leading to the harming of his
fundamental right. The neglect of the concerned authorities has led to the
petitioner not being able to clear the mains examination which might have
been cleared had the authorities been careful or even if the marks had been
provided for the incorrect questions.

The concerned authorities denied any help regarding the same issue when the
petitioner approached them. A reply was given by one of the official that there
was nothing that the authorities could now do as the answers and marks were
now released.

The impugned result as given out by the examination authorities should not be
accepted as a genuine one as a total of 12 marks have been wrongly deducted
from the petitioner’s answer sheet leading to a selection not on the basis of
merit but on biasness Thus this Writ Petition for appropriate reliefs.

Hon’ble the Chief Justice and His Lordship’s Companion Justice


of the High Court of Uttar Pradesh. The Humble petition of the
Petitioner above named.

MOST RESPECTFULLY SHOWETH:


1. That the petitioner is a citizen of India residing at 468-GF, Hazrat ganj,
Lucknow that the petitioneris of 30 years of age and is aggrieved by the
act of the concerned authorities in the Uttar Pradesh Judicial Examinations
held on 28th july, 2018.
2. That the bone of contention is that as per the Answer key declared on
28thAugust, 2018 a total of 12 questions were wrong i.e. the questions
stated were wrong. No compensation in terms of marks for the
abovementioned questions was given which meant deduction of marks
from the paper.
3. That the neglect of the concerned authorities has led to the petitioner not
being able to clear the mains examination which might have been cleared
had the authorities been careful or even if the marks had been provided for
the incorrect questions.
4. That the petitioners have thus approached the Hon’ble court on amongst
others the following grounds.
GROUNDS:
5. Because the action of the respondent is contrary to the equal and good
conscience.
(a) That the action of the respondent is arbitrary, unreasonable,
irrational and unconstitutional.
(b) That respondent has no right to play with the career of the
petitioner.
6. That the Petitioner has no other alternative efficacious remedy except to
approach this Hon’ble Court by way of this writ petition.
7. That there has been no undue delay in filing of this petition.
8. That the honourable court has territorial jurisdiction to entertain the writ
petition.
9. That the requisite court fee of Rs. 70/- has been affixed on this petition.
10. That the petitioner has not filed any other similar writ petition either before
this Hon’ble Court or before the Supreme Court of India.

PRAYER:
The petitioner most humbly prays that this Hon’ble Court may be pleased to:-
(a) Issue appropriate writ in the nature of mandamus or any other appropriate
writ directing the Respondents to cancel the illegal appointment.

(b) Issue necessary directions to appointment of petitioner and


(c) Issue any other further order/orders or direction/directions as this Hon’ble
Court may deem fit and appropriate number the facts and the circumstances of
this case.

1. I am the petitioner in the above Writ Petition. I am acquainted with
the facts and circumstances of the case. I am swearing this affidavit
on my own behalf
2. All the averments made in the accompanying Writ Petition (Civil)
are true to the best of my knowledge and information and they may
be read and treated as part of this affidavit. Exhibits produced
along with the Writ Petition (Civil) are true copies of the original
documents.
3. The petitioner has not filed earlier any petition seeking similar and
identical reliefs in respect of the same subject matter.
All the facts stated above are true to the best of my knowledge,
information and belief.
