Executive Order No. 192 (1987)
“Designated the Department of Environment and
Natural Resources (DENR) as the primary
government agency responsible for the
conservation, management, development and
proper use of the country’s environment and
natural resources. Its Environmental
Management Bureau (EMB) is specifically tasked
to recommend rules and regulations for EIA and
provide technical assistance for their
implementation and monitoring.”

Presidential Decree 1151: Philippine
Environmental Policy (1977)
The Philippine EIS System was first issued and
required “all agencies and instrumentalities
of the national government, including
government-owned and controlled
corporations, as well as private
corporations, firms and entities to prepare
an environmental impact statement (EIS) for
every action, project or undertaking which
significantly affects the quality of the
environment.”

Presidential Decree 1586: The
Philippine EIS System (1978)
Reiterated the policy statement
under PD 1151 and declared ECPs
and projects within ECAs as projects
which require the submission of an
EIS.

Section 4 of PD 1596
“. . . .No person, partnership or
corporation shall undertake or operate
any, or in part, such declared
Environmentally Critical Project (ECP)
or project within an Environmentally
Critical Area (ECA) without first
securing an Environmental Compliance
Certificate (ECC). . . .”.

OVERVIEW
Section 9 of PD 1596 : Penalty for Violation.
”Any person, corporation or partnership found
violating Section 4 of this Decree, or the terms
and conditions in the issuance of the
Environmental Compliance Certificate .. shall be
punished by the suspension or cancellation of
his/its certificate or and/or a fine in an amount
not to exceed Fifty Thousand Pesos (P50,000.00)
for every violation thereof, at the discretion of
the DENR”.

a) The EIS System is concern primarily
with assessing the direct and
indirect impacts of a project on the
biophysical and human environment
and ensuring that these impacts are
addressed by appropriate
environmental protection and
enhancement measures

b) The EIS System aids Proponents in
incorporating environmental
considerations in planning their
projects as well as determining the
environment’s impacts of their
projects

C) Project proponents are responsible for
determining and disclosing all relevant
information necessary for a
methodological assessment of the
environmental impacts of their projects

D) Review of the EIA reports by EMB shall be guided
by 3 general criteria:
(1) that the Environmental considerations are integrated
into the over all project planning;

- a process of predicting and evaluating the likely
impacts of a project (including cumulative
impacts) on the environment during construction,
commissioning, operation, and abandonment.
