EMPLOYMENT CONTRACT

KNOW ALL MEN BY THESE PRESENTS:

This contract is entered into this __________ by and between:

____________________________, a business enterprise registered and


existing in accordance with the laws and regulations of the Republic of the
Philippines, represented in this act by ____________________________, of
legal age, Filipino, married and with residence at Brgy. 109, Tacloban City,
Philippines, (referred to as the “FIRST PARTY”); and

____________________________, of legal age, Filipino and a resident of


____________________________, Philippines, (referred to as “SECOND
PARTY”)

WITNESSETH:

THAT, the FIRST PARTY is in need of a direct-hire laundry shop staff/personnel


for the operation of a business establishment registered under the name
“____________________________” with principal place of business in Tacloban City;

THAT, the SECOND PARTY applied with the FIRST PARTY for said position
and the latter accepted such application;

WHEREFORE, in consideration of the foregoing, the parties hereto enter into an


Employment Contract whereby the FIRST PARTY hires and employs the SECOND
PARTY under the following terms and conditions:

1. Nature of employment: The SECOND PARTY shall be initially engaged under a


Probationary employment not exceeding six (6) months from the date the he
started working. The services of the SECOND PARTY may be terminated for just
cause or when he fails to qualify as a regular employee in accordance with
reasonable standards made known by the FIRST PARTY to the SECOND PARTY
at the time of this engagement. If the SECOND PARTY is allowed to work after
the probationary period, he shall be considered a regular employee.

2. Hours of work: The SECOND PARTY agrees to give his undivided time and
service in the employ of the FIRST PARTY, starting from 8:00 in the morning
until 6:00 in the afternoon for ___ consecutive days a week, in such capacity as
the latter may direct from the time of execution of this contract until such time
that the former resigns from employment or when his employment is otherwise
terminated in accordance with the appropriate provisions of the Labor Code or
this contract.

3. Compensation: The SECOND PARTY shall receive a daily compensation of


_____ PESOS, Philippine Currency, to be given on __________ of every
workweek. Other entitlements and benefits provided by law shall likewise be
given by the FIRST PARTY as may be applicable.

4. Standards of employment: The SECOND PARTY shall comply with the
standards, terms and conditions stipulated herein and those mandated by laws,
including the internal policies, such as, but not limited to the following:

General standards, terms and conditions

4.1. Refraining from acts/behaviors that go against persons, business properties


and interest, security and public order, morals, administration and against
authority;
4.2. Preventing abuse of the usage of FIRST PARTY’s property and/or using
FIRST PARTY’s resources for personal benefit;
4.3. Avoiding unreasonable absences, tardiness, malingering, feigning sickness,
fraudulence or willful breach of contract, insubordination, coercion, rumor
mongering resulting to damages to concerned party and deliberate acts of
negligence resulting to FIRST PARTY loss;
4.4. Meeting the required skills, competencies prescribed and overall standard of
performance required by the FIRST PARTY.

Internal Policies

The SECOND PARTY shall:


4.5. Maintain cleanliness in all areas within the workplace, upon arrival every
morning and before closing the shop;
4.6. Always wear your uniform or clothes that are at least presentable to the
customers;
4.7. Observe courtesy and give assistance to customers as may be necessary;
4.8. Ask customers if there are clothes that require special treatment to avoid
discoloration. If so, do not include in the washing of the laundry and proceed
to wash separately with the special technique/treatment;
4.9. Inform the clients of the RYA policy of “Pay now wash later”;
4.10.Always remind the customer to fill up the claim stub and not to leave any
blank space in the CS.
4.11.Always issue receipt to the customer and remind the customer not to lose the
claim stub;
4.12.Handle the laundry carefully to avoid loss, damage or interchange with other
clothes by: (1) washing dirty whites clothes before loading in the laundry
machine; (2) checking the pockets for any items that may cause damage to
the machine and/or laundries; and (3) segregating the laundry according to
owner/batch, type of clothing, and suitable washing style.
4.13.Return recovered items from the laundry of the owner-customer (attached/
place in the finish/packed laundry) and inform the customer about the said
item/s;
4.14.Operate and maintain the washing/laundry machines properly and in
accordance with the training employed by the FIRST PARTY, and always
clean filters every after washing of the laundry;
4.15.Defer/prevent the release of finished laundry without the claim stub;
4.16.No cash advances are allowed except during emergencies.

5. Termination: The FIRST PARTY shall have the right to terminate the SECOND
PARTY’s services anytime during the Probationary Period for any of the
justifiable causes enumerated herein.

6. Confidentiality: The Parties may be required to exchange proprietary and
confidential documents and information in relation to this Agreement and thereby
agree as follows in relation to such exchange of Information:

6.1. All Information the disclosing party makes available to the other shall be
received and examined by the receiving party under the strict obligation of
maintaining its confidentiality;

6.2. The Information shall be treated as confidential at the highest level, and their
knowledge shall be exclusively limited to the persons in charge of the
execution and administration of the purpose set out in this Agreement or of
any contract resulting therefrom;

6.3. The Information shall neither be used nor transmitted to any third parties
without the prior written consent of the disclosing party;

6.4. The Parties acknowledge and agree that they shall not be responsible or
liable for any losses or damages sustained by either party in reliance upon
such Information, provided however that a disclosing party shall not willfully
disclose to a receiving party Information that is misleading or inaccurate;

6.5. The receiving party will, upon request from the disclosing party, promptly
return to the disclosing party all Information/documents (including all copies
thereof) provided by the other disclosing party, provided however, that the
receiving party shall be entitled to retain working papers and copies of the
Information to the extent consistent with good professional practice for legal
and archival purposes.

7. Revisions, amendments and waivers: This Contract may be modified or revised


by a written request form any of the participating PARTIES citing therein specific
clause(s) to be revised or modified and the corresponding amendment(s) thereto.

It is understood that the failure of either parties to demand strict compliance with
any or all of the terms and conditions of this Contract shall not be construed as a
waiver and/or estoppel on their part of the enforcement of their rights in
connection herewith.

ACKNOWLEDGMENT
