vacate!the!December!2001!order.!This!petition!was!filed!on!the!ground! proceedings,! where! the! innocence! or! guilt! of! a! person! is! not! an! issue.!

provisional!arrest!and!detention!from!1999!to!2001!upon!the!request!of! prohibiting!him!from!exercising!his!constitutional!right!to!post!bail.!
HKAD!for!charges!of!bribery!and!conspiracy!to!defraud!before!the!Hong! !
Kong!court.!In!November!1999,!HKAD!filed!a!petition!for!extradition!of! The! applicable! standard! of! due! process,! however,! is! different!
respondent!Muñoz!while!at!about!the!same!time,!he!filed!a!petition!for! between!extradition!and!criminal!proceedings.!In!the!latter,!due!process!
bail.!The!first!judge!(Bernardo,!Jr.)!denied!the!bail!on!the!grounds!that! is! premised! on! the! presumption! of! innocence! of! the! accused.! In! the!

respondent! Muñoz! worth! P750,000.! Petitioner! immediately! filed! a! extradition!proceeding,!being!a!sui'generis,'requires!a!standard!of!proof!
motion!to!vacate!the!order!but!this!was!denied!by!respondent!judge.! for! bail,! and! according! to! Justice! Puno! in! Purgnan,' only! “clear! and!
! convincing!evidence”!will!be!considered.!Private!respondent!did!not!yet!
ISSUE:$$ present!any!evidence!to!show!that!he!was!not!a!“flight!risk”.!
Whether! or! not! the! constitutional! provision! on! bail! applies! to! !
