AFFIDAVIT OF QUITCLAIM AND WAIVER OF RIGHTS

That I, ________________________________________, of legal age, Filipino


and with residence and postal address at ______________, Philippines, after having been
duly sworn to in accordance with law, hereby depose and say:

1. That our father, QUINTIN AMBAY (deceased) and ROSARIO AMBAY,


the mother of CLAUDIO GATARIN owned in common a parcel of land
more particularly described as follows;

“A parcel of land designated as Lot 793-pt, situated at


Yapac, Malay Aklan with an area of 6800 square meters,
more or less, bounded in the North by Lot#793-pt.-P.
Ambay; on the South by Lot # 789; on the East by Brgy.
Road and on the West by Lot # 793-pt. – E. Sacapano.
Said land is declared in the name of QUINTIN AMBAY
under ARP/TD No. 017-0108-0109 for the year 1994.

2. That in a Deed of Adjudication with Waiver of Rights executed by us


before Notary Public Higino c. Macabales dated June 10, 2004 and
recorded in his Notarial Book as Doc. No. 296; Page No. 60; book No.
XIV; Series of 2004, we have adjudicated unto ourselves the above
described parcel of land;
3. That recognizing the ownership of CLAUDIO GATARIN over the
aforementioned parcel of land declared in the name of QUINTIN
AMBAY, we, Heirs of QUINTIN AMBAY do hereby waive, renounce,
quitclaim and return any and all rights, interest and participation
whatsoever over the above-mentioned parcel of land in favor of
CLAUDIO GATARIN, his heirs, successors and assigns now and in
perpetuity;
4. That we do not interpose nor object to the issuance of new Tax Declaration
in the name of CLAUDIO GATARIN;
5. That we hereby acknowledged any act of ownership of said CLAUDIO
GATARIN over the above described parcel of land;
6. That we are executing this affidavit freely and voluntarily fully aware of
the consequences of this document;

AFFIDAVIT OF ADJUDICATION

I, ABC, of legal age, Filipino, single and a resident of No. 123 Municipality of
AAA, Province of BBB, Philippines, after having been duly sworn in accordance with
law, do hereby depose and say:
1. That I am the only daughter of X who died intestate ini the Municipality
of AAA, Province of BBB, on April 08, 2002 as evidenced by Death
Certificate issued by the Municipality of AAA, Province of BBB, hereto
attached as ANNEX “A” and made an integral part of this Affidavit;

2. That the said deceased left deposit in the Rural Bank of AAA, Inc., in
the amount of P300,000;

3. That the said deceased left no debts;

4. That pursuant to Rule 74, Sec. 1 of the Rules of Court, I hereby


adjudicate unto myself the above described real estate by means of this
Affidavit and hereby files the same with the Register of Deed of BBB
with the request that the said adjudication be made effective without
judicial proceeding as prescribed by the aforementioned Rules of Court.
