AFFIDAVITOFADVERSECLAIM
I, GabyS.Tay,oflegalage,adulyregisteredretireeunderthePhilippine
RetirementAuthority,andaresidentofDavaoCity,Philippines,afterhavingbeen
dulysworntoinaccordancewithlaw,deposeandstatethat:
1. IwassearchingforaplacetoresideinthePhilippinesandsoughtthe
assistanceofMannyYak.HesuggestedthatthetitleofthepropertyIwillpurchase
willberegisteredinthenameofaFilipinoCitizenwhoItrust;
2. I then found a house and lot for sale located in somewhere village
throughtheinternetwhichwasownedbyMr.Developer;
3. Subsequently,ItoldManny thatIwillpurchasethepropertyandI
wouldliketohaveitregisteredinthenameofmyfriend,RickyBangao.However,
Mannysuddenlychangedhersuggestionandsaidthatitwouldbebettertoregister
thepropertyunderhisname.IagreedtohersuggestionbecauseIwasnotfamiliar
withPhilippineLaws.Ialsohavenoreasontodoubthersuggestionatthattime;
4. OnMay24,2013,Ithenmadeadepositwiththeownerofthehouse,
and the latter in turn executed a document acknowledging the receipt of the
reservationfeefromme;
5. Afterwards,OnMay30,2013,MannytoldmethatIshouldtransfer
moneyfrommyDeutscheKreditbankaccountinGermanytothePhilippinebank
accountsofMannyforthepaymentofthepurchasepriceofthehouse.Iaccededto
herinstructionsbutthetransferwasmadewiththeindicationthatthemoneyis
earmarkedforthepurchaseofahouseandlotin___City;
6. AsIwasworriedthatIhavenoholdofanydocumenttoshowthatI
amtherealowneroftheproperty,ItoldMannytoexecutefurtherdocumentsto
show myownership over the property. Hence, therewas this document called a
MemorandumofAgreement1whichhemademesigntellingmethatitwouldbe
theproofofmyownership.IexecutedthesaidMemorandumofAgreementwith
him since I was not familiar with Philippine Laws. Furthermore, I would have
never parted with my hardearned money were in not for the assurance and
assertionsofMannyYak;
7. On September 2014, a representative of the City Assessors Office
came to my house and asked about the real property taxes of the house and
building. I did not have a copy of any document since all of them were in the
possessionofManny;
8. IaskedMannyseveraltimestofurnishmethedocuments,buthedid
notfurnishmeanycopyofit.Instead,heonlyofferedmeplentyofexcuses.First,

shesaidthatitisstillbeingprocessed.Sometimeafter,shetoldmethatthesaid
documentsarewiththePhilippineRetirementAuthority.Next,hesaiditiswith
theRegistryofDeeds;
9. AsIwasbeginningtosuspecttheexplanationsandactsofManny,I
then went to the Registry of Deeds for further inquiries. To my surprise and
disappointment,Idiscoveredthatthepropertywasalreadyregisteredinthename
ofMannyyAkasshowninTCTNo.14622222222,moreparticularlydescribedas
follows:

moreorless.xxx.
10. IthenaskedMannytogivemethedocumentssothatIcanexecutethe
proper Deed of Sale and transfer the property to my partner, Ricky Bangao.
However,hesaidthathewouldbetheonetodothesame;
11. Notcontentedwithhisresponse,Isubsequentlycontactedhimthrough
atextmessage(shortmessageservice)inordertogetthedocumentsbutheonly
respondedwithharshwords.RickyBangaoalsotriedtocontacthimbutManny
onlyrespondedwiththreats;
12. Thus,duetothefraudwhichMannyYakcommittedandhiscontinued
refusaltotransfertheregistrationofthepropertyinthenameofRickyBangao,I
wasconstrainedtogettheservicesofalawyertoprotectmyrightsandownership
overtheaforesaidproperty.IhavealsofiledacriminalcaseagainstMannyYakfor
fraud;
13. Hence,forthetimebeing,IamexecutingthisAffidavitforthepurpose
ofattestingtothetruthfulnessoftheforegoingallegationsandinsupportofmy
requestfortheannotationofanadverseclaimovertheparceloflandcoveredbythe
TransferCertificateofTitle(TCT)No.146wwwwww
