THE DEFENDANT HAS BEEN ARRESTED UPON THE FOLLOWING INFORMATION OR OBSERVATION: (MAKE A PLAIN, CONCISE AND DEFINITIVE STATEMENT OF ESSENTIAL FACTS CONSTITUTING THE OFFENSE CHARGED.)
On August 29, 2015,Montgomery County police officers responded to 20201 Watkins Mill Road
(Great Seneca Stream Valley Park unit #1) Germantown, Montgomery County, Maryland, to assist
Maryland National Capital Park Police with the discovery of human remains. An unidentified body
was discovered in a shallow grave. Identification was not possible at that time. The body was
removed on the second day of processing and Dr. William Rodriguez, forensic anthropologist from
the Office of the Chief Medical Examiner (OCME), responded to assist. Numerous stab wounds were
observed to the upper body and head, with blunt force trauma to the head as well. The scene was
consistent with a gang style murder. Forensic Investigator Richard Tobin responded to the scene
and ordered the victims remains sent to the OCME for an autopsy. The cause of death was ruled
a homicide and the manner of death was multiple sharp instrument stab wounds.
Information regarding the unidentified male in the grave was sent out to the media by the
Montgomery County Department of Police and a subject named Marvin Misael Vargas-Osorio was

developed as the possible unidentified person discovered in the grave on August 29, 2015.
Medical records subsequently positively identified the remains in the grave as being Marvin
Misael Vargas-Osorio.
On December 21, 2015, an individual named Edwin Ernesto Reyes-Martinez was arrested for his
involvement in a gang murder that occurred on or about November 2, 2015 in Gaithersburg,
Maryland. Reyes-Martinez was transported to Montgomery County Police headquarters. After waiving
his rights, Reyes-Martinez stated to your affiant that he knew Marvin Misael Vargas-Osorio.
Reyes-Martinez stated that he has known Vargas-Osorio for approximately one year and that he
knew him by his nickname of "Mango. He also stated that "Mango" was a friend of his family.
Reyes-Martinez went on to state that on the day Vargas-Osorio ("Mango") was murdered, he
was contacted by Suspect #1 (S-1). S-1 told Reyes-Martinez to meet him at the park near his
home. Reyes-Martinez responded to the park and was met by S-1 and a second suspect (S-2). S-1
told Reyes-Martinez to stand on the trail in the park and to keep a lookout for any passersby
and to notify S-1 and S-2 by audible sound if anyone was approaching. As he was standing on the
trail, Reyes-Martinez observed Suspect #3 (S-3) approaching him with "Mango" (Marvin Misael
Vargas-Osorio). He greeted "Mango" and "Mango" and S-3 continued on to meet S-1 and S-2 who were
standing approximately twenty three feet from where he (Reyes-Martinez) was standing on the
trail. "Mango", S-1, S-2, S-3 then met up with two other suspects (S-4, S-5). At this point,
Reyes-Martinez observed all five suspects stab "Mango". He described that all five suspects had
knives and two of the suspects were to the rear of "Mango" stabbing his body in a slashing
motion. Reyes-Martinez stated that he saw blood gushing from the front of "Mango's" body as well
as the rear. He stated that two suspects continued to stab "Mango" while he was on the ground.
Two of the five suspects then put "Mango's" body in a grave. Reyes-Martinez stated that the
grave appeared to have been previously dug. After "Mango" was buried the five suspects left the
scene. During the interview, Reyes-Martinez stated to your affiant (through a Spanish

Reyes-Martinez stated that he has known Vargas-Osorio for approximately one year and that he
knew him by his nickname of "Mango. He also stated that "Mango" was a friend of his family.
Reyes-Martinez went on to state that on the day Vargas-Osorio ("Mango") was murdered, he
was contacted by Suspect #1 (S-1). S-1 told Reyes-Martinez to meet him at the park near his
home. Reyes-Martinez responded to the park and was met by S-1 and a second suspect (S-2). S-1
told Reyes-Martinez to stand on the trail in the park and to keep a lookout for any passersby
and to notify S-1 and S-2 by audible sound if anyone was approaching. As he was standing on the
trail, Reyes-Martinez observed Suspect #3 (S-3) approaching him with "Mango" (Marvin Misael
Vargas-Osorio). He greeted "Mango" and "Mango" and S-3 continued on to meet S-1 and S-2 who were
standing approximately twenty three feet from where he (Reyes-Martinez) was standing on the
trail. "Mango", S-1, S-2, S-3 then met up with two other suspects (S-4, S-5). At this point,
Reyes-Martinez observed all five suspects stab "Mango". He described that all five suspects had
knives and two of the suspects were to the rear of "Mango" stabbing his body in a slashing
motion. Reyes-Martinez stated that he saw blood gushing from the front of "Mango's" body as well
as the rear. He stated that two suspects continued to stab "Mango" while he was on the ground.
Two of the five suspects then put "Mango's" body in a grave. Reyes-Martinez stated that the
grave appeared to have been previously dug. After "Mango" was buried the five suspects left the
scene. During the interview, Reyes-Martinez stated to your affiant (through a Spanish

On August 29, 2015,Montgomery County police officers responded to 20201 Watkins Mill Road
(Great Seneca Stream Valley Park unit #1) Germantown, Montgomery County, Maryland, to assist
Maryland National Capital Park Police with the discovery of human remains. An unidentified body
was discovered in a shallow grave. Identification was not possible at that time. The body was
removed on the second day of processing and Dr. William Rodriguez, forensic anthropologist from
the Office of the Chief Medical Examiner (OCME), responded to assist. Numerous stab wounds were
observed to the upper body and head, with blunt force trauma to the head as well. The scene was
consistent with a gang style murder. Forensic Investigator Richard Tobin responded to the scene
and ordered the victims remains sent to the OCME for an autopsy. The cause of death was ruled
a homicide and the manner of death was multiple sharp instrument stab wounds.
Information regarding the unidentified male in the grave was sent out to the media by the
Montgomery County Department of Police and a subject named Marvin Misael Vargas-Osorio was

developed as the possible unidentified person discovered in the grave on August 29, 2015.
Medical records subsequently positively identified the remains in the grave as being Marvin
Misael Vargas-Osorio.
On December 21, 2015, an individual named Edwin Ernesto Reyes-Martinez was arrested for his
involvement in a gang murder that occurred on or about November 2, 2015 in Gaithersburg,
Maryland. Reyes-Martinez was transported to Montgomery County Police headquarters. After waiving
his rights, Reyes-Martinez stated to your affiant that he knew Marvin Misael Vargas-Osorio.
