I. REFERENCES:
a) PNP LOI 2005 TAMANG BIHIS, Campaign against the Illegal
Manufacture, Distribution, Sale and Use of PNP Uniforms, Insignias and other
Accoutrements, which include the materials for their production.
b) Executive Order No 297 dated October 04, 2000, Regulating the
Manufacture, Sale, Distribution and Use of PNP Uniforms, Insignias and other
Accoutrements;
c) Implementing Rules and Regulations (IRR) of EO No. 297;
d) Article 179, RA No. 3815 as amended, the Revised Penal Code of 1932,
re-Illegal Use of Uniform and Insignia;
e) Proposed Organizational Charts TF BANTAY BIHIS Annex A.
II. PURPOSE:
This Letter of Instruction 2007-01 defines the creation of TF BANTAY
BIHIS that shall be employed during the intensified implementation of LOI 2005
TAMANG BIHIS, the campaign against the Illegal Manufacture, Distribution, Sale
and illegal use of PNP Uniforms, Insignias and other Accoutrements including the
materials for their production. This campaign is expected to minimize if not totally
eradicate unauthorized or sub-standard uniform, equipment and accoutrements
that are available in the market. The operational activity of Task Force BANTAY
BIHIS shall be strengthened by the provisions of EO 297 and other related laws
such as RA 3815 and Art 179 of the Revised Penal Code; while its administrative
aspect shall be guided by the existing provisions of the PNP Rules and
Regulations.
III. SITUATION:
Efforts of the PNP to curb and regulate the unauthorized manufacture,
distribution, sale and use of PNP uniforms, insignias and other accoutrements
have not been successful. People engaged in this kind of business sprouted in the
market with no concern on approved specifications and standard materials in their
production, selling and distribution of PNP uniforms and accoutrements.
The unauthorized and sub-standard productions of PNP uniforms, insignias
and other accoutrements and use of non-specs materials for their productions in
the market may result to destructive criticisms on the image-building of the PNP.
The non-uniformity and non-conformity of textiles colors, designs and materials
use in the production of PNP uniforms and use of sub-standard materials of metals
on insignias and other accoutrements will stain the image of the PNP personnel in
uniform and shall bring shame on the credibility of the whole PNP in general.
On serious instances, lawless individuals take advantage in purchasing
PNP uniforms, insignias and other accoutrements from authorized and
unauthorized manufacturers, dealers and sellers for their own illegal intentions.
Consequently, it is an embarrassment for the image-building of the PNP to see the
organization in adverse situation. Hence, the formation and activation of TASK
FORCE BANTAY BIHIS is necessary, to administer the screening, inspection
and investigation of the manufacturers, distributors, sellers and retailers of
PNP uniforms, equipment and insignias for the accomplishment of LOI
TAMANG BIHIS.
IV. MISSION:
The PNP through its TASK FORCE BANTAY BIHIS shall administer the
implementation of LOI 2005 TAMANG BIHIS and other related laws, insure
proper wearing of standard uniforms by PNP personnel and stop the manufacture
and sale of unauthorized or sub-standard PNP uniforms and accessories.
V. OBJECTIVES:
The formation of Task Force BANTAY BIHIS, which shall be composed of
officers and personnel from the different offices of the PNP, shall have the following
objectives:
a. Complete compliance by all PNP personnel in wearing the authorized and
prescribed uniforms, insignias and accoutrements set by the PNP Uniform and
Equipment Standardization Board and duly approved by the NAPOLCOM;
b. Stoppage in the supply of unauthorized uniforms relentless and
intensified campaigns against known illegal manufacturers, sellers, distributors and
users of unauthorized PNP uniforms, insignias and other accoutrements;
c. Well informed public and PNP personnel thru information campaign
measures being implemented relative to this matter through tri-media;
d. Appropriate cases/charges filed against persons/ individuals found to be
violating this LOI.
VI. EXECUTION:
A. Concept of Operations:
For efficient and actual performance of TF BANTAY BIHIS, three (3)
Courses of Action are outlined as basis in the successful implementation of this
LOI 2005-TAMANG BIHIS.
a. ACTION 1 Identification and Dissemination of Information
a.1. Identify all PNP known manufacturers, dealers and
suppliers of PNP uniforms, insignias and other accoutrements and inform them of
the provisions stated in LOI 2005 TAMANG BIHIS.
a.2. On the spot inspection of personnel to ensure that they
are all complying and wearing the prescribed PNP uniforms, insignias and other
accoutrements. After which, the team inspecting shall conduct PI & E to persuade
and encourage PNP personnel to buy only at the PNP SSS and at its outlets
including PNP cooperative stores.
b. ACTION 2 Intelligence Efforts
b.1. Information gathering and production of intelligence reillegal and unauthorized manufacture, distribution, sale and illegal use of PNP
uniforms, insignias and other accoutrements.
b.2. Case build-up on OCGs (Organized Crime Groups) or
individuals disguising as policemen in the conduct of their nefarious activities.
c. ACTION 3 Law Enforcement and Investigation
c.1. Exercise visitorial power pursuant to the provisions of
section 4 of EO 297 and the IRR (Implementing Rules and Regulations) signed by
the C, PNP on February 08, 2006, to all known dealers, manufacturers and sellers
of PNP uniforms, insignias and other accoutrements.
c.2. Filing of administrative, civil and/or criminal charges
against violators of LOI 2005 TAMANG BIHIS and its related laws.
c.3. After filing of civil and or criminal charges for flagrant
violations of LOI 2005 TAMANG BIHIS, recommend for immediate closure and
cancellation of business permits and include the name(s) to the list of blacklisted
suppliers, dealers, manufacturers for future reference.
B. TASKS:
DPRM
Issue orders for the activation of TF BANTAY BIHIS
Issue orders of PNP personnel to compose TF
BANTAY BIHIS
Detail Ex-O, DPRM as Deputy Task Force Commander
OPR in the conduct of inspections and compliance of
the PNP personnel in the proper wearing and usage of PNP uniforms, equipment,
insignias and accoutrements;
Perform other tasks as directed
DRD
OPR of LOI 2007-1, Creation of Task Force BANTAY
BIHIS;
Monitor closely the execution of TF BANTAY BIHIS;
Designate DDRD as TF Commander, TF BANTAY
BIHIS; and
Perform other tasks as directed
3. DI/IG
Detail PCO (C, CSD for DI and C, CIOD for IG)/PNCO
personnel to compose the intelligence staff of the TF Bantay-Bihis in the national
level;
Detail Regional Officers and PNCOs to compose the
intelligence staff of the TF Bantay-Bihis in the regional level;
Provide intelligence support by gathering information,
case-build-up and evidence gathering and preservation; and
Perform other tasks as directed.
4. DL
Ensure
the procurement of authorized uniforms,
insignias and accoutrements;
Provide logistical support to the Task Force BantayBihis;
Detail PCO (C, Supply Management Division)/PNCO to
compose the logistics staff of the Task Force; and
Perform other tasks as directed.
5. DC
Provide appropriate funds to support the operational
and administrative activities of the Task Force Bantay-Bihis; and
Perform other tasks as directed.
6. DIDM
Conduct Pre-Charge Investigation and file appropriate
administrative charges against PNP personnel patronizing unauthorized PNP
uniforms, insignias and other accoutrements; and
Perform other tasks as directed.
7. DPCR
Undertake police information efforts on LOI TAMANG
BIHIS and utilize the tri-media on our campaign against illegal manufacturers,
dealers/suppliers and illegal use of PNP uniforms, equipment and accoutrements;
and
Perform other tasks as directed.
8. CIDG
Detail C, Anti-fraud Division and PNCOs to compose
the intelligence and investigation of the TF in the national level;
Conduct operations against violators and file
appropriate charges if evidence warrants; and
Perform other tasks as directed.
9. Legal Service
Designate C, Legal Assistance Division to act as legal
adviser of the Task Force Bantay Bihis;
Provide legal assistance to the Task Force; and
Perform other task as directed.
10. PNPSSS
Ensure that only authorized uniforms, insignias and
accoutrements are sold in the store in coordination with DRD, PROs, Dirs, NSUs;
and
Perform other tasks as directed.
11. Other D-Staffs
Encourage PNP personnel assigned within respective
offices/units to use and patronize only authorized PNP uniforms, insignias and
other accoutrements; and
Perform other tasks as directed.
12. Directors, NSus (NASUS and NOSUS)
Activate Task Group Bantay-Bihis within their Level
and Sub-Task Groups on Regional/Provincial Level, whenever applicable;
Designate Deputy Director for Administration as TG
Commander of the TG Bantay-Bihis and Chief Admin Division as Deputy Task
Group Commander;
Supervise, orchestrate, direct and administer the
conduct of inspections to all personnel an subordinate offices of the unit;
Ensure the strict implementation of this LOI by all
members of the unit.
13. RDs, PROs 1-13, COR, ARMM & NCRPO
Activate Task Group Bantay-Bihis within Regional
Level and Sub-Task Groups on Provincial Level;
Designate DRDA as TG Commander of the TG
Bantay-Bihis and C, RPHRDD as Deputy Task Group Commander respectively;
Supervise, orchestrate, direct and administer the
conduct of intelligence build-up, active police operations and information campaign
against the unauthorized manufacture, sale and distribution of PNP uniforms and
equipment;
Ensure the strict implementation of this LOI within
respective AORs;
Conduct regular inspection to all PNP Offices to ensure
that uniforms being worn by PNP personnel are authorized and conforms the right
specifications;
Direct all PDs to activate Provincial Task Group and
designate their Dep PDs as TG Commander, TG Bantay Bihis; and
Perform other tasks as directed.
VI.
COORDINATING INSTRUCTIONS:
a.
Respect for human rights must be observed at all times.
b. Strict adherence to the PNP Operational Procedures (Rules of
Engagement) shall be emphasized.
c. All Chiefs of offices/units are advised to conduct regular inspection to
ensure that PNP personnel are patronizing the authorized PNP uniforms, insignias
and accoutrements.
d. All Chiefs of offices/units shall make sure that LOI 2005 TAMANG
BIHIS is strictly implementated.
e. Dirs, NSUs and RDs, PRO1-13, ARMM, COR and NCRPO are advised
to submit respective IMPLAN to DRD (attn: TF Comdr, TF BANTAY BIHIS NLT ten
(10) days upon receipt of approved LOI.
f. Dirs NSUs and RDs, PRO1-13, ARMM, COR and NCRPO shall submit
accomplishment report to DRD.
