SEC. 4. Derivative Citizenship. /// The un8arrie4 chil4+ 1hether legiti8ate+ illegiti8ate or a4opte4+ belo1 eighteen <?@= 7ears of age+ of those 1ho re/ac5uire Philippine citi3enship upon effecti9it7 of this Act shall be 4ee8e4 citi3ens of the Philippines. SEC 5. Civil and Political Rights and Responsibilities . /// Those 1ho retain or re/ac5uire Philippine citi3enship un4er this Act shall enAo7 full ci9il an4 political rights an4 be subAect to all atten4ant liabilities an4 responsibilities un4er eBisting la1s of the Philippines an4 the follo1ing con4itions2 (1) Those inten4ing to eBercise their right of suffrage 8ust 8eet the re5uire8ents un4er 'ection ?+ Article C of the Constitution+ Republic Act No. ?@ other1ise 0no1n as 2The O9erseas Absentee Coting Act of !66.2 an4 other eBisting la1s>
(2) Those see0ing electi9e public office in the Philippines shall 8eet the 5ualifications for hol4ing such public office as re5uire4 b7 the Constitution an4 eBisting la1s an4+ at the ti8e of the filing of the certificate of can4i4ac7+ 8a0e a personal an4 s1orn renunciation of an7 an4 all foreign citi3enship before an7 public officer authori3e4 to a48inister an oath> (3) Those appointe4 to an7 public office shall subscribe an4 s1ear to an oath of allegiance to the Republic of the Philippines an4 its 4ul7 constitute4 authorities prior to
their assu8ption of office: Pro9i4e4+ That the7 renounce their oath of allegiance to the countr7 1here the7 too0 that oath. (4) Those inten4ing to practice their profession in the Philippines shall appl7 1ith the proper authorit7 for a license or per8it to engage in such practice> an4 (5) That right to 9ote or be electe4 or appointe4 to an7 public office in the Philippines cannot be eBercise4 b7+ or eBten4e4 to+ those 1ho: (a) are can4i4ates for or are occup7ing an7 public office in the countr7 of 1hich the7 are naturali3e4 citi3ens> an4Dor (b) are in acti9e ser9ices as co88issione4 or non/co88issione4 officers in the ar8e4 forces of the countr7 1hich the7 are naturali3e4 citi3ens. RULES GOVERNING PHILIPPINE CITIZENSHIP UNDER REPUBLIC ACT (R.A.) NO. 9225 AND ADMINISTRATIVE ORDER (A.O.) NO. 91, SERIES OF 2004
HEREAS, R.A. N!. 9225 declares that the natural-born citizens of the Philippines who become citizens of another country shall be deemed not to have lost their Philippine citizenship under conditions provided therein; HEREAS, A.O. N!. 91, Section8 1 designates the Bureau of Immigration (BI ! in consultation with the "epartment of #oreign $ffairs ("#$ ! "epartment of %ustice ("&% &ffice of the 'ivil (egistrar-)eneral! *ational Statistics &ffice (*S& ! as the implementing agency of (+$+ *o+ ,--./ HEREAS, A.O. N!. 91, Section - authorizes the BI to promulgate and issue rules and regulations to implement (+$+ *o0 ,--./ 123(3#&(3! by authority of $+&+ *o+ ,1 Section - in relation to 'ommonwealth $ct *o+ 415! Section 5! as amended! the following rules are hereby adopted to carry out the provisions of (+$+ *o+ ,--.+ Section 1. C!"#$%&#. 6 7hese rules shall apply to former natural-born citizens of the Philippines ! as defined by Philippine law and 8urisprudence! who have lost their Philippine citizenship by reason of their naturalization as citizens of a foreign country+ Section 2. of (egistration ($'( and issuance of an Identification 'ertificate (I' ! as the case may be! under (+$+ *o+ ,--.+ Section 3. F!$'#$ (%)*$%+,-!$( P./+/00/(# 1/)/2#( 6.! /5 %-$!%3 -*) % BI,$#&/5)#$#3 %+/#( 6 $ former natural-born citizen of the Philippines who is abroad but is a BI-registered alien shall file a petition under oath to the nearest Philippine #oreign Post for evaluation+ 7hereafter! it shall forward the entire records to the 'ommissioner of Immigration for the cancellation of $lien 'ertificate of (egistration ($'( and issuance of an I' under (+$+ *o+ ,--.+ Section 4. F!$'#$ (%)*$%+,-!$( P./+/00/(# 1/)/2#( %+$#%34 /( ).# P./+/00/(#5 %(3 (!) % BI,$#&/5)#$#3 %+/#( 6 $ former natural-born citizen of the Philippines who is already in the Philippines but has not registered with the BI within si9ty (4: days from date of his arrival shall file a petition under oath to the 'ommissioner of Immigration for the issuance of an I' under (+$+ *o+ ,--.+ Section 5. F!$'#$ (%)*$%+,-!$( P./+/00/(# 1/)/2#( 6.! /5 %-$!%3 %(3 (!) % BI,$#&/5)#$#3 %+/#( 6 $ former natural born citizen of the Philippines who is abroad and not a BI-registered alien shall file a petition under oath to the nearest Philippine #oreign Post for the issuance of an I' under (+$+ *o+ ,--.+ Section 6. F!$6%$3/(& %33$#55. P.!)!&$%0.5. 6 In all petitions under Section - and . hereof! the applicant must indicate his or her latest forwarding address+ 7hree (5 recent -; 9 -; photographs of the applicant (front! left side! and right side views over white bac<ground shall be attached to the petition+ Section . Fee!. 6 3ach applicant under these (ules shall pay a one-time fee for the processing of the application and issuance of the corresponding I'. $pplicants already in the Philippines shall attach the official receipt for the amount of P-!.::+:: as proof of payment of processing fee+ $pplicants who are abroad shall attach the official receipt for the amount of =S>.: or its e?uivalent in foreign currency acceptable to the Philippine #oreign Post concerned+ Section ". P$!!7 %5 (%)*$%+ -!$( 1/)/2#( !7 ).# P./+/00/(#5 + 6 $ former natural-born citizen of the Philippines! who was born in the Philippines! shall submit the *S&-authenticated copy of his or her birth certificate. &n the other hand! a former natural-born citizen of the Philippines! who was born abroad! shall submit the original copy of the (eport of Birth issued by the Philippine #oreign Post and in applicable cases! the Birth 'ertificate issued by competent foreign authorities+ 7hese documents shall be sufficient to establish that the applicant is a natural-born citizen of the Philippines for purposes of these (ules+ Section #. S*-'/55/!( !7 ).# O%). !7 A++#&/%(1# 6 $pplicant under these (ules shall also sign and attach an &ath of $llegiance to the (epublic of the Philippines as follows0 I (name of the applicant solemnly swear (or affirm that I will support and defend the 'onstitution of the (epublic of the Philippines and obey the laws and local orders promulgated by the duly constituted authorities of the Philippines and will maintain true faith and allegiance thereto! and that I impose this obligation upon myself voluntarily without mental reservation or purpose of evasion+ Section 10. Strict compliance+ E77#1) !7 (!(,1!'0+/%(1#. 6 $ll petitions must strictly comply with the preceding re?uirements prior to filing at the &ffice of the 'ommissioner or at the nearest Philippine #oreign Post! as the case may be+ $fter the filing of the petition! the same shall be assigned to an evaluating officer who shall evaluate the petition without further proceedings+ In the case of petitions that do not comply with the re?uirements! the applicant shall be notified to submit the re?uired documents within thirty (5: days from receipt thereof+ &therwise! the petition shall not be favorably acted upon the Bureau of Immigration or by the Philippine #oreign Post+ Section 11. A00$!"%+ P$!1#3*$#5+ 6 If the petition is found to be sufficient in form and in substance! the evaluating officer shall submit the findings and recommendation to the 'ommissioner of Immigration or 'onsul-)eneral! as the case may be! within five (. days from the date of assignment+ #or applications filed under Sections - and @ of these (ules! the 'ommissioners of Immigration shall issue! within five (. days from receipt thereof! an &rder of $pproval indicating that the petition complies with the provisions of (+$+ *o+ ,--. and its I((! and further direct the 'hief of
the $lien (egistration "ivision ($(" to cancel the sub8ect $'( andAor to issue the corresponding I' to the applicant+ 3ach cancelled $'( shall however! be attached to the &rder of $pproval to form part of the records of the applicant+ #or the applications filed under Section 5 and . of these (ules! the 'onsul-)eneral shall issue! within five (. days from receipt thereof! the &rder of $pproval indicating that the petition complies with the provisions of (+$+ *o+ ,--. and its I((+ 2e shall then transmit copies of the &rder of $pproval! &ath of $llegiance! including the authenticated (ecord of Birth or Birth 'ertificate to the BI+ Immediately upon receipt thereof! the BI shall issue the corresponding I' to the applicant and forward the same to the Philippine #oreign Post concerned+ If the applicant is a BI-registered alien! the BI shall also cancel the sub8ect $'(+ Section 12. C!(7#$'#() !7 ).# P./+/00/(# C/)/2#(5./0. C!(3/)/!(5. 6 Sub8ect to full compliance with these (ules! the &ath of $llegiance shall be the final act that confers Philippine citizenship+ In case the applicant is in the Philippines! he may ta<e his &ath of $llegiance before the 'ommissioner of Immigration or any office authorized under e9isting laws to administer oath+ In the latter case! the applicant must submit the &ath of $llegiance to the BI to form part of his records+ In case the applicant is abroad! only the 'onsul-)eneral or a duly commissioned foreign service officer of the Philippine #oreign Post concerned shall administer the &ath of $llegiance+ 7he &ath of $llegiance shall thereafter be registered in accordance with the provisions of the 'ivil (egistry laws+ Section 13+ R#0!5/)!$4 R#1!$35. 6 7he BI (ecords Section shall maintain the integrity of all the documents filed under these (ules+ It shall send official copies of the &rder of $pproval and &ath of $llegiance to the *S&+ Section 14. C!0/#5 7!$ ).# A00+/1%(). I3#()/7/1%)/!( C#$)/7/1%)#. C!$$#1)/!(5 !7 #$$!$5. 6 7he applicant shall be provided with an official copies of the of the &rder of $pproval and the &ath of $llegiance+ #urther! all I'Bs issued under these (ules shall indicate Philippine citizenship under (+$+ *o+ ,--. and $+&+ *o+ ,1! s+ -::@+ $ny clerical error or errors in the entries of the I' may be corrected! upon written re?uest to and approval by the 'ommissioner of Immigration+ 7he *S& shall be promptly provided with a copy of the corrected I'+ Section 15. C!(7/3#()/%+/)4 !7 R#1!$35+ 6 $ny application! document or information given before the Bureau of Immigration or any Philippine #oreign Post shall not be divulged in any manner to any person or entity without the e9press written consent of the person to whom such application! record or information belongs+ Section 16. N!. 9225. 6 7his memorandum circular shall e?ually apply to the unmarried child! whether legitimate! illegitimate or adopted! below eighteen (18 years of age! of those who re-ac?uire Philippine citizenship upon the effectivity of (+$+ *o+ ,--.+ Section 1 .
