HYDERABAD Action Contemplated against students for indulging in and abetting ragging in the college. Depending upon the nature and gravity of the offence as established, the possible punishments, for those found guilty of ragging at college level shall be anyone or combination ofthefollowing. Cancellationofadmission Suspensionfromattendingclasses Withholding.Iwithdrawingscholarship/fellowshipandother Debarring from appearing in any test / examination or other evaluation process Withholdingresults DebarringfromrepresentingtheInstitutionin anyregional,nationalorinternationalmeet, tournament,youthfestival,etc. Suspension/Expulsionfromthehostel. RusticationfromtheInstitutionforperiodraggingfrom1to4semesters Expulsion from the Institution and consequent debarring from admission to any other Institution. Collective punishment: When the persons committing or abetting the crime of ragging are not identified, the Institution shall resort to collective punishment as a deterrent communitypressureonthepotentialraggers. SALIENTFEATURES: Clause 3: What Constitutes Ragging Ragging constitutes one or more of any of the following acts: a. Any conduct by any student or students whether by words spoken or written to by an act which has the effect of teasing, treating or handling with rudeness a fresher or any other student. b. Indulging in rowdy or indiscipline activities by any student or students which causes or is likely to cause annoyance, hardship, physical or psychological harm or to raise fear or apprehensionthereofinanyfresheroranyotherstudent. c. Askinganystudenttodoanyactwhichsuchstudentwillnotintheordinarycoursedoand which has the effect of causing or generating a sense of shame, or torment or embarrassment so as to adversely affect the physique or psyche of such fresher or any otherstudent. d. Anyactaseniorstudentthatprevents,disruptsordisturbstheregularacademicactivityof anyotherstudentorafresher; e. Exploiting the services of a fresher or any other student for completing the academic tasks assignedtoanindividualoragroupofstudents. f. Any act of financial extortion or forceful expenditure burden put on a fresher or any other studentbystudents. g. Any act of physical abuse including all variants of it sexual abuse, homosexual assaults, stripping,forcingabsenceandlewdacts,gestures,causingbodilyharmoranyotherdanger tohealthorperson; h. Any act or abuse by spoken words, emails, post, public insults which would also include deriving perverted pleasure, vicarious or sadistic thrill from actively or passively participatinginthediscomfituretofresheroranyotherstudent; i. Anyactthataffectsthementalhealthandselfconfidenceofafresheroranyotherstudent with or without an intent to derive a sadistic pleasure or showing off power, authority or superioritybyastudentoveranyfresheroranyotherstudent. Clause7:ActiontobetakenbytheHeadoftheInstitution:Onreceiptoftherecommendation oftheAntiRaggingSquadoronreceiptofanyinformationconcerninganyreportedincidentof ragging. The Head of Institution shall immediately determine if a case under the penal laws is made out and if so, either on his own or through a member of the AntiRagging Committee authorizedbyhiminthisbehalf,proceedtofileaFirstInformationReport(FIR),within24hours of receipt of such information or recommendation, with the police and local authorities, under theappropriatepenalprovisionsrelatingtooneormoreofthefollowing,namely: i. Abetmenttoragging; ii. Criminalconspiracytorag; iii. Unlawfulassemblyandriotingwhileragging; iv. Publicnuisancecreatedduringragging; v. Violationofdecencyandmoralsthroughragging; vi. Injurytobody,causinghurtorgrievoushurt; vii. Wrongfulrestraint; viii. Wrongfulconfinement;

ix. Useofcriminalforce; x. Assaultaswellassexualoffencesorunnaturaloffences; xi. Extortion; xii. Criminaltrespass; xiii. Offencesagainstproperty; xiv. Criminalintimidation; xv. Attemptstocommitanyoralloftheabovementionedoffencesagainstthevictim(s); xvi. Threattocommitanyoralloftheabovementionedoffencesagainstthevictim(s); xvii. Physicalorpsychologicalhumiliation; xviii. Allotheroffencesfollowingfromthedefinitionof"Ragging". Provided that the Head of the Institution shall forthwith report the occurrence of the incident of ragging to the District Level AntiRagging Committee and the Nodal officer of the affiliating University,iftheInstitutionisanaffiliatedInstitution. Provided further that the Institution shall also continue with its own enquiry initiated under clause 9 of these Regulations and other measures without waiting for action on the part of the police/local authorities and such remedial action shall be initiated and completed immediately and in no case later than a period of seven days of the reported occurrence of the incident of ragging. CLAUSE9:Administrativeactionintheeventofragging: 9.1 The Institution shall punish a student found guilty of ragging after following the procedure andinthemannerprescribedhereinunder: a. The AntiRagging Committee of theInstitution shall take anappropriatedecision, in regard topunishmentorotherwise,dependingonthefactsofeachincidentofraggingandnature and gravity of the incident of ragging established in the recommendations of the Anti RaggingSquad. b. The AntiRagging Committee may, depending on the nature and gravity of the guilt established by the AntiRagging Squad, award, to those found guilty, one or more of the followingpunishments,namely; I. Suspensionfromattendingclassesandacademicprivileges. II. Withholding/withdrawingscholarshipfellowshipandotherbenefits. III. Debarringfromappearinginanytest.Examinationorotherevaluationprocess. IV. Withholdingresults. V. Debarring from representing the institution in any regional or international meet, tournament,youthfestival,etc. VI. Suspension/expulsionfromthehostel. VII. Cancellationofadmission VIII. RusticationfromtheInstitutionforperiodrangingfromonetofoursemesters. IX. Expulsion from the Institution and consequent debarring from admission to any other institutionforspecifiedperiod. Provided that where the persons committing or abetting the act of ragging are not identified,theinstitutionshallresorttocollectivepunishment. c. AnappealagainsttheorderofpunishmentbytheAntiRaggingCommitteeshalllie,

i. In case of an order of an Institution, affiliated to or constituent part, of a University, to theViceChancelloroftheUniversity. ii. IncaseofanorderofaUniversity,toitschancellor. iii. In case of an institution of national importance created by an Act of Parliament, to the ChairmanorChancelloroftheInstitution,asthecasemaybe. PLEDGETOBEADMINISTEREDTOTHESTUDENTS I, a bonafide student of MBA II Year at Pendekanti InstituteofManagementdoherebysolemnlypledgethat 1) I shall not indulge in any ragging activities either directly or indirectly, either on the campusoroutsidethereof. 2) I further pledge that I shall treat all my junior students and also other students as my bothersandsistersatalltimes. 3) I shall maintain cordial atmosphere on the campus and shall follow strict discipline. I shall report any incident of ragging to the concerned authorities as soon as it comes to mynotice. 4) I shall say no to ragging and shall not be a party to ragging either as a participant or as anabettor;and
5) I shall do all that is possible to make my institution a better place for learning, enlightenment andenjoyment.

TheOffenceoftheraggingisnotonlypunishableundersection4ofAndhraPradeshProhibition of Ragging Act 1997 but also under various provisions of the Indian Penal Code (IPC), 1860 (Act 45of1860)andisacognizableoffence. I. 1. 2. 3. 4. 5. 6. 7. 8. Factors enlisted by the Dr. Raghavan Committee on effective prevention of ragging in educationalinstitutions. Primaryresponsibilityforcurbingraggingrestswithacademicinstitutionsthemselves. Raggingadverselyimpactsthestandardsofhighereducation. Incentives should be available to institutions for curbing the menace and there should be disincentivesforfailuretodoso. Enrolment 'in academic pursuits or a campus life should not immunize any adult citizen frompenalprovisionsofthelawsoftheland. Ragging needs to be perceived as failure to inculcate human values from the schooling stage. Behaviouralpatternsamongstudents,particularlypotential'raggers',needtobeidentified. Measuresagainstraggingmustdeteritsrecurrence. Concerted action is required at the level of the school, higher educational institution, district administration, University, State and Central Governments to make any curb effective. Mediaandthecivilsocietyshouldbeinvolvedinthisexercise. RecommendationsapprovedbytheSupremeCourt. 1. The Punishment to be meted out has to be exemplary and justifiably harsh to act as deterrentagainstrecurrenceofsuchincidents.

Every single incident of ragging where the victim of his parent/guardian or the Head of InstitutionisnotsatisfiedwiththeInstitutionalarrangementforaction,firstinformation report (FIR) must be filed without exception by the Institutional authorities with the local police authorities. Any failure on the part of the institutional authority or negligenceordeliberatedelayinlodgingtheFIRwiththelocalpoliceshallbeconstrued to be an act of culpable negligence on the part of the institutional authority. If any victim or his parent/guardian of ragging intends to file FIR directly with the police, that willnotabsolvetheinstitutionalauthorityfromtherequirementoffilingtheFIR. 3. In the prospectus to be issued for admission by educational institutions, it shall be clearlystipulatedthatincaseoftheapplicantforadmissionisfoundtohaveindulgedin ragginginthepastorifitisnoticedlaterthathehasindulgedinragging,admissionmay berefusedorheshallbeexpelledfromtheeducationalinstituion. 4. It shall be the collective responsibility of the authorities and functionaries of the concerned institution and their role shall also be open to scrutiny for the purpose of finding out whether they have taken effective steps for preventing ragging and in case of their failure, action can be taken for example,denial of any grantinaid or assistance fromtheStateGovernments. 5. AntiraggingcommitteesandsquadsshallbeforthwithformedbytheInstitutionsandit shall be the job of the committee or the squad, as the case may be, to see that the committee's recommendations, more particularly those noted above, are observed without exception and if it is noticed that there is any deviation, the same shall be forthwithbroughttothenoticeofthiscourt. 6. Thecommitteeconstitutedpursuanttotheorderofthiscourtshallcontinuetomonitor the functioning of the antiragging committees and the squads to be formed. They shall also monitor the implementation of the recommendations to which reference has been madeabove. AndhraPradeshProhibitionofRaggingAct,1997 Section4:WhatconstitutesRaggingandPunishment? 1) Whoever, with theintention of causing ragging or with the knowledge that he is likely by suchacttocauseragging,commitsorabetsraggingandthereby 2) Teases or embarrasses or humiliates a student shall be punished with imprisonment for a term which may extend to 6 months or with fine which may extend to one thousand rupeesorwithboth;or 3) Assaultsorusescriminalforcetoorcriminallyintimidates,astudentshallbepunishedwith imprisonmentforatermwhichmayextendto1yearorwithfinewhichmayextendtotwo thousandrupeesorwithboth;or 4) Wrongfully restrains or wrongfully confines or causes hurt to a student shall be punished with imprisonment for a term which may extend to 2 years or with fine which may extend tofivethousandrupeesorwithboth;or 5) Causesgrievoushurttoorkidnapsorabductsorrapesorcommitsunnaturaloffencewitha student shall be punished with imprisonment for a term which may extend to 5 years and withfinewhichmayextendtotenthousandrupees;or

6) Causes death or abets suicide shall be punished with imprisonment for life or with imprisonment for a term which may extend to ten years and with a fine which may extend tofiftythousandrupees. Section5:EffectsofPunishmentofRagging 1) A student convicted of an offence under section 4 and punished with imprisonment for a termshallbedismissedformtheeducationalinstitution. 2) A student convicted of an offence under section 4 and punished with imprisonment for a termofmorethansixmonthsshallnotbeadmittedinanyothereducationalinstitution. The Fundamental Rights are defined as the basic Human Rights of all citizens. These rights, defined in part III of the Constitution, apply irrespective of race, place of birth, religion, caste/cred,genderandareenforceablebythecourts,subjecttospecificrestrictions. These fundamental rights enable the people to live freely and happily in a Democratic setup. Theyarethenaturalrights.Theyareessentialforgoodlife.Theyareasfollows: 1) The right to Equality (Articles 14 to 18): Our Constitution guarantees the Right to equality forallcitizens,inIndia,theruleoflawisfollowed. 2) Right to Freedom: Freedom of the individual is the essence of Democracy. According to this all citizens have freedom of thought and have equal rights to freedom of speech and expression. Nobody can be punished except for the violation of law. Every individual's life, personallibertyandhumanrightsaresafeguardedandprotectedintheConstitution. 3) Right against Exploitation: No individual can be forced or completed to do work without wages. Women and children should not be exploited. Children below 14 years should not beemployedorengagedtoworkinanyfactoryormineorinanydangerousworks. 4) Right to Freedom of Religion: The Constitution guaranteesreligious freedom to all citizens of India. All religions are treated alike. Freedom is given to all religious bodies to manage their affairs. The government does not interfere in the religious practice of the people excepttomaintainpublicorder. 5) Cultural and Educational Rights: India is a land of many languages, scripts and cultures. There are many minority groups. They have the right to conserve their culture. They have the right to establish and administer educational institutions of their choice. The Constitution provides protection for the cultural and educational rights of all groups of peopleinIndia. 6) RighttoConstitutionalRemedies:TheRighttoConstitutionalRemediesenablethecitizens togotheSupremeCourtdirectlywhenthereisanyviolationofFundamentalRights. RAGGINGAVIOLATIONOFHUMANRIGHTS Ragginginanyformisnotonlyanoffencebutitisalsoaviolationofhumanrightsofthevictim. TheprotectionofHumanrightsacts,1993defines"HumanRights"asthe"therightsrelatingto life,liberty,equalityanddignityoftheindividualguaranteedbytheconstitutionorembodiedin theInternationalConvenantsandenforceablebycourtsinIndia". ThereisawellestablishedstatutorymechanisminIndiatoenforcetheHumanRights. A victim of ragging can approach the State Human Rights Commission, the State Commission for scheduled castes and scheduled tribes, the state minorities commission and also the State Commission for Women, under the provisions of the Protection of Human Rights Act, 1993. These commissions are empowered to inquire into the complaints, call for information or

reportfromtheGovernmentoranyoranyotherauthorityororganization,andmaytakeanyof thefollowingstepsuponthecompletionofaninquiryheldnamely. (1) Where the inquiry discloses, the commission of violation of human rights, or negligence in the prevention of violation of human rights by a public servant, it may recommend to the concerned Government or authority the initiation of proceedings for persecution or such otheractionasthecommissionmaydeemfitagainsttheconcernedpersonorpersons; (2) Approach the Supreme Court or the High Court concerned for such directions, orders or writsasthatCourtmaydeemnecessary;and (3) Recommend to the concerned Government or Authority for the grant of such immediate interim relief to the victim or the members of his family as the commission may consider necessary. RAGGINGAVIOLATIONOFFUNDAMENTALDUTIES Ragging is an instance of human depravity and a symbol of uncivilized behaviour on the part of a person. In order to inculcate a sense of selfdiscipline to make all the citizens perfect human beings, the Constitution of India has incorporated 11 fundamental Duties imposed on the citizens. Any student who understands and assimilates the importance of the fundamental dutieswouldcertainlynotindulgeinanyactofraggingitshallbethedutyofeveryeducational institution to impart. The knowledge relating to the fundamental duties to all the students and of every student to discharge such duties. If these duties are effectively discharged by the above mentioned stakeholders, ragging can be curbed effectively. The fundamental Duties are extractedhereunderforreadyreference. PARTIVA(ARTICLE51A):FUNDAMENTALDUTIES ItshallbethedutyofeverycitizensofIndia (a) To abide by the Constitution and respect its deals and institutions, the National Flag and theNationalAnthem; (b) Tocherishandfollowthenobleidealswhichinspiredournationalstruggleforfreedom; (c) Toupholdandprotectthesovereignty,unityandintegrityofIndia; (d) Todefendthecountryandrendernationalservicewhencalledupontodoso; (e) To promote harmony and the spirit of common brotherhood amongst all the people of India transcending religious, linguistic and regional or sectional diversities; to renounce practicesderogatorytothedignityofwomen; (f) Tovalueandpreservetherichheritageofourcompositeculture; (g) To protect and improve the natural environment including forests, lakes, rivers and wild life,andtohavecompassionforlivingcreatures; (h) Todevelopthescientifictemper,humanismandthespiritofinquiryandreform; (i) Tosafeguardpublicpropertyandtoabjureviolence; (j) To strive towards excellence in all spheres of individual and collective activity so that the nationconstantlyrisestohigherlevelsofendeavourandachievement,and (k) Who is a parent or guardian to provide opportunities for education to his child or, as the case may be, ward between the age of six and fourteen years. The Fundamental Duties are defined as the moral obligations for all citizens to help promote a spirit of patriotism andtoupholdtheunityofIndia.
