The respondent has appealed the Immigration Judge's decision rendered on October 22, 2012. A review of the record of proceeding reveals a portion of the recording of the testimony of the hearing is missing. The written transcript and the recording of the October 22, 2012, hearing, reflect that the Immigration Judge briefly stopped the recording of testimony to permit the respondent and her counselor a few minutes to speak together in private (Tr. at 83). However, when the hearing resumed the recording cut off abruptly during a colloquy between respondent's counsel .and the Immigration Judge. It unfortunately cannot be detennined what occurred thereafter and how much of the transcript is missing. As a complete the transcript necessary for our review of this matter, we will return the record to th. Immigration Court for e further action. Upon receipt of the record, the Immigration Court shall take such steps as are necessary and appropriate to enable preparation of a complete transcript of the proceedings including a new hearing, if necessary. ORDER: The record is returned to the Immigration Court for further action as appropriate and certification to the Board by the Immigration Judge thereafter.
