Dear network, Over the past few weeks, we have told you a lot about German procedural law and litigation before state #courts in our "Insights into Dispute Resolution in Germany". In our #CommercialLitigation Team at Hausfeld, we not only handle proceedings before state courts, but also frequently act for our clients in (international) #arbitration proceedings. The advantages of such arbitration proceedings are, of course, well known: The proceedings are confidential, the parties have an influence on the composition of the arbitral tribunal and the proceedings are concluded much more quickly. On 1 February 2024, the German Federal Ministry of Justice published a draft regulation to modernise German arbitration law. The aim is to adapt arbitration law as a whole to the needs of today's world, increase its efficiency and thus strengthen Germany's attractiveness as an arbitration centre. Most international practitioners don’t openly talk about it, but nearly everyone has faced it at least once. Non-arbitration-friendly jurisdictions. It’s one of those things we brush under the rug, even though it’s so central to what we do. A few years ago, we were engaged by a client in a high-stakes arbitration against a party from a Central Asian country, one widely regarded as having a non-arbitration-friendly stance. The arbitration itself was seated in London. But the real challenge came when it was time to enforce the award. Suddenly, everything became complicated. The local courts seemed hesitant, leaning heavily toward their own national (and it’s a known fact!). ‘twas a sobering reminder that even the best-drafted arbitration clause or the most well-conducted proceedings can run into a wall when enforcement is sought in jurisdictions like this. We talk about crafting airtight arbitration clauses, picking the perfect seat, and debating procedural nuances, but we don’t talk enough about what happens when you hit a system that doesn’t play by the same rules. We need to discuss dead-end situations like this more as enforcement isn’t just the end of the process—it’s where it all comes to life. Towards the end of the last century, the US Supreme Court took a gamble and stated the then unproven method of dispute resolution, arbitration, was acceptable and even desirable in competition cases. Reasons given were arbitration’s built-in flexibility, expertise, and expediency.
