The issue of seafarers’ rest hours is one that has plagued the maritime industry for as long as I can remember. Since I began my career, these rest hours have been a constant point of contention. What I often observe, especially in offshore operations, is that rest hour records are maintained purely for inspection purposes—to tick a box. It's a system designed to appear compliant but, in reality, doesn't reflect the actual working conditions on board. A major contributing factor to this disconnect is that many of those in HSE departments at offshore offices lack firsthand experience as mariners or offshore operators. They operate strictly according to the book, without truly understanding the complexities and unpredictability of real-life ship operations. This lack of practical understanding means that these issues are repeatedly overlooked and ignored. Despite the presence of MLC 2006 and STCW conventions, which are designed to protect seafarers, the system still feels like a paperwork exercise rather than an effective safety measure. What makes this even more challenging is the inconsistency in enforcement and interpretation of rest hour regulations. Ships that honestly report breaches face detention, while those who manipulate their records and appear compliant escape penalty-free. The result? A system that rewards dishonesty, promotes stress, and endangers the well-being of crews. The reality is that the regulations don't always reflect the operational demands that ships face. Emergencies or unavoidable operations often require rest hour breaches, but there’s little room for genuine understanding or flexibility. The constant pressure to meet shipping schedules, coupled with the lack of understanding from shore-based personnel, leaves the crew in a dangerous predicament. We need to rethink how we approach and enforce these regulations to ensure that they protect crew members, rather than serving as mere administrative tasks. 🚨 Work Rest Hours: The System is Broken 🚨 We all know breaching work rest hours is forbidden by STCW and MLC, but here’s the reality: ships that honestly report breaches are getting detained by PSC, while the ships that lie and don’t report properly are passing inspections without any fines. How is it possible that PSC can’t recognize these lies? In modern shipping, it’s nearly impossible not to breach rest hours. Breaching is forbidden, but it can be done in case of emergencies or unavoidable operations. But here’s the problem—what is an unavoidable operation? I can tell you one thing, and an inspector might disagree. The lack of clear understanding leaves too much room for interpretation, putting crews at risk. I don’t see the problem with reporting breaches and then giving the crew compensatory rest. But the system is set up to promote lies because anyone who reports a breach is subject to detention. The work rest hours system is outdated and only puts stress on the ship. If a Master decided to stop the ship to let the crew rest, cargo would never be delivered. But if the crew works through and breaches rest hours, they are put in danger. And who gets the blame? Always the ship. Charterers just keep scheduling cargoes like there’s no tomorrow, without understanding the real demands on operations.
