The DGCCRF - Ministère de l'Économie is gaining more power thanks to the SREN Act (https://lnkd.in/gQmjs_9W). 👉🏽 Transparency and Information: - Platforms must provide clear and transparent information about products and sellers, including contact details, reviews, and warranties. - They must also disclose if they favor certain sellers or products. 👉🏽 Security Measures: - Online marketplaces must implement measures to prevent the sale of dangerous or counterfeit products. - They should actively monitor listings and respond promptly to any issues. 👉🏽 Reporting Illicit Content: - Platforms must establish effective reporting procedures for illicit content (e.g., counterfeit products, hate speech, etc.). - They must take swift action to remove such content. 👉🏽 Collaboration with Authorities: - The DGCCRF can request information from platforms and compel them to cooperate in investigations. - Platforms are expected to collaborate with authorities to ensure consumer safety. 👉🏽 Sanctions: - Non-compliance with these obligations may result in financial penalties of up to 6% of global revenue. https://lnkd.in/gC_9iyd5

EuroCommerce welcomes the special report by the European Court of Auditors on Digital #payments in the EU https://lnkd.in/eDtKNrPA. They recommend to have clear criteria to assess the impact of #priceinterventions, such as the #interchangefeeregulation #IFR and to have clear timelines. Previous studies (e.g. by VVA) confirmed that the #caps are working, but missed the point that other fees, such as for commercial cards and scheme fees, have dramatically increased, all but eating up the benefits of IFR. It's time for a full review of IFR even though it is a lot of work. The historic grounds and modelling that let to 0,2/0,3% may no longer be valid. However, a merchant indifference test is an imperfect tool, as it only looks at the current state and does not take into account the future with instant payments or CBDCs. We reiterate the point that which SCA applied, it should not matter (in terms of fees) if the underlying card/account is consumer/commercial, domestic/non-domestic, debit/credit or if the transaction is e-commerce or in store. Once successfully authorised and authenticated, it’s out of the merchant hands in terms of liability and exposure. We challenge ad valorem (= %-based) fees. Only with fees per transaction, merchants will gain access to economies of scale from higher volumes/values of transactions. It’s been nearly two months since the EU’s Digital Services Act came into effect. What has happened so far? The DSA does not exclusively impact European businesses – it affects international tech companies, including many from the US – that provide services to 10% or more of the EU’s population (around 45 million citizens). The risk factors to be considered are significant and include know your business (KYB) processes and supplier due diligence. The new KYB obligations mean providers must obtain and verify key information from traders/third parties selling products or offering services via their platform. “Chinese online marketplace Temu was asked on Friday to provide more information on the measures it has taken against traders selling illegal products on its platform under the EU’s online platform rules, the European Commission announced today. The company will also need to give additional data and information on the measures it has adopted to mitigate the risk of the spread of illegal products, as well as risks related to consumer protection, public health and users’ wellbeing, the statement said. Temu, which was founded by PDD Holdings in 2022, will also have to provide information on recommender systems and the risk to the protection of users’ personal data. #Today, the #Commission has sent a #RFI to #Temu under the #DSA, requesting the platform to provide detailed information and internal documents on the mitigation measures taken against the presence and reappearance of #traders #selling #illegal #products on its online marketplace. Moreover, the Commission is also requesting details on the #recommender #systems of Temu and the risk to the protection of users' #personal #data.
