🔄 🗓️ On May 16, 2024, the California State Assembly passed the “Click-to-Cancel” bill (AB2863), amending the Automatic Renewal Law. This bill, which mirrors amendments the Federal Trade Commission proposed earlier this year, is now headed to the State Senate. If California adopts the bill, it will impose stricter regulations on auto-renewal services. 🚨 🌟 The most important part of the bill is the click-to-cancel provision, which gives the bill its name. Business would be required to allow consumers to cancel their auto-renewal subscriptions as easily as they can sign up. 📜✅ In addition, the bill includes other key requirements: 1. Businesses must obtain a consumer’s affirmative consent to an auto-renewal service “separately” from the rest of terms. 2. Businesses must keep verification of consumer affirmative consent for at least three years or one year after contract termination, whichever is longer. 3. Businesses must not include any information that undermines consumer’s ability to provide affirmative consent. 4. Businesses must not misrepresent any material fact about their services. 5. Businesses must send annual reminders with service details, charge frequency and a cancellation mechanism. 6. Businesses must notify customers about price increases at least 45 days in advance. 7. Businesses must provide consumers with notices detailing the amount and frequency of charges before obtaining their billing information. 8. For businesses offering cancellation via a toll-free number, calls must be answered promptly for at least 12 hours between 6 a.m. and 10 p.m. #AutoRenewal #ConsumerProtection #CaliforniaLaw
