Most homes will likely contain lithium or lithium-ion-powered device. They’re used in everyday items like phones, laptops, vapes, and e-scooters, but what people may not know is that they can be a big fire risk. Mishandling, overcharging, and hoarding old batteries are dangerous things to do, as they can lead to fires. At Allianz UK, we’ve seen home fire claims started by lithium batteries double from 2022 to 2023. Worryingly, over a third of people (34%) are unaware of the fire risks these devices pose when being charged overnight. To address this, we’ve partnered with firefighter Angela Everington to provide essential fire safety information and help increase understanding of the risks associated with lithium batteries. Slip and fall cases can be tough because the plaintiff has to show notice. In other words, the plaintiff must show that the property owner knew or should have known that there was something dangerous on their property that caused plaintiff to fall down. A recent case shows how tricky this can be. In Gonzalez, the plaintiff tripped on an orange that was in the shopping center walkway for at most 9 minutes. The court analyzed Defendant’s conduct-employees underwent about 90 days of training on how to maintain the safety of the common area walkways. Electronic sensors were installed in the facility that “pinged” when employees completed their sweeps of the area ensuring pedestrian safety. The property owner had adopted employee training and maintenance programs reasonably calculated to ensure regular and active inspections of the floor in the common areas of the shopping center. Under these circumstances, the property owner lacked constructive knowledge of the spilled oranges. It's not often you find a property owner that goes to such great lengths to ensure pedestrian safety and a commitment to removing tripping hazards! #personalinjury #premisesliability
