In this case focussing on the well-known but little understood concept of ex aequo et bono decision-making, Shai makes an excellent case that having such a mechanism (even if unused) has multiple and tangible benefits. How ADR is useful in the corporate world ADR is like the corporate world’s legal hack—efficient, cost-effective, and a lot less combative than litigation. It saves companies from the heavy costs and delays of court battles, allowing disputes to be settled privately without dragging trade secrets through public courts. Think of mediation as the legal version of conflict resolution therapy, where businesses can maintain relationships instead of burning bridges.
