While serving as Judge Advocate at many courts-martial trials and in private practice, I discovered that most members of the Bar and some members of our appellate courts are yet to know the functions of principal members of courts-martial including the nature and number of offenses contained in some sections of the AFA. Certainly a court proceeding where neither the counsel nor the court understands the nature of the offense in a section of the AFA and the roles of every member of a court-martial would eventually produce a judgment equivalent to a guess work. P.S. I break down the subject of military law into easy-to-understand posts, articles, and resources. We summarise our previous postings on Emergency (Defense) Regulations 1945. 1) This law is a British law enacted during the Mandatory Period 2) Two days before Israel declares a state, this law has been revoked 3) Instead of adopting a formal constitution, Israel reinstates this law 4) This law is used on Palestinians only 5) Israel states this law is applicable as Jordan has never gazetted the law 6) But the law itself says it doesn’t need to be gazetted 7) This law states that civil offences go to civil court, but Israel sends Palestinians to Military Courts Why is Israel contradicting itself? #palestine #legal #law #israel #illegal #selective#selectiveprosecution #administrativedetention #military#militarycourt #civil #civilcourt #court #liberation #justice #freepalestine

We are proud to announce the release of a new book: Modern Military Justice, Cases and Materials by Dean Lisa Schenck (The George Washington University Law School)! This book comprehensively covers the modern military justice system of the United States under the Uniform Code of Military Justice. It has been updated to address significant changes to the UCMJ and the Manual for Courts-Martial since publication of the Third Edition in the Spring of 2019. The materials included come from every Service within the Armed Forces and show how the military justice system addresses criminal offenses, ranging from minor infractions to serious offenses such as the misconduct of soldiers at Abu Ghraib prison. The text covers the jurisdiction of courts-martial; sources of military law; the role of judge advocates; military offenses and defenses; pre-trial, trial, and appellate military justice (criminal) procedures; nonjudicial punishment and other alternatives to courts-martial; expanding military justice including trial of civilians by courts-martial; the relationship of courts-martial to state and federal courts; and much more. All chapters include policy questions about currently controversial issues. The text is appropriate for all students, whether or not they have had prior military experience.

Here's how to fight back: 1. Understand your rights: - Board hearing vs. notification: You have a right to a board hearing for certain discharges (Other Than Honorable) or if you meet specific criteria. - Representation: You have the right to legal counsel, both military and civilian. - Evidence and testimony: You can present evidence, call witnesses, and testify on your behalf. 2. Secure strong legal support: - Experienced military defense attorney: They understand the complexities of administrative discharge proceedings and protect your rights. - Build a solid defense: Gather evidence, witness statements, and refute accusations. - Navigate the process: They guide you through each step, ensuring fairness and due process. 3. Take proactive steps: - Don't delay: Contact a lawyer immediately upon receiving separation notification. - Cooperate, but don't waive rights: Respond to inquiries honestly, but don't admit guilt or waive legal rights. - Prepare for the board hearing: Work with your lawyer to gather evidence, practice testimony, and present your case effectively. Remember: - Consequences are serious: Discharge impacts benefits, future employment, and reputation. - You have options: A strong defense can significantly improve your chances of a favorable outcome. Pakistan's Supreme Court announced its intention to investigate accusations of ISI meddling in judicial matters, following a letter from six high court judges. The tension between Pakistan's judiciary and military establishment has been highlighted by revelations of 'blatant interference' by the intelligence agency, raising concerns about judicial autonomy and public confidence in the legal framework. Past episodes of friction between the judiciary and the military, along with public reactions and political maneuverings, have followed a familiar pattern. Some are questioning whether this could lead to a lawyers' movement, similar to the one that contributed to the ouster of military dictator Pervez Musharraf in 2007-08. However, others believe it is a prolonged struggle without an imminent conclusion. #AsiaRisk #GeopoliticalConflictandDisputes #India Follow us for daily updates on risk and operations in Asia! https://lnkd.in/gU-6P2k6

Nuts & Bolts of the International Criminal Court Arrest Warrants in the ‘Situation in Palestine’ An excellent explainer, from Tom Dannenbaum following the ICC’s Pre-Trial Chamber I issue of three warrants: one for Israeli Prime Minister Benjamin Netanyahu, one for former Israeli Defense Minister Yoav Gallant, and one for Mohammed Diab Ibrahim Al-Masri (commonly known as “Deif”), the leader of Hamas’s military wing. Deif is presumed dead, but, unlike Ismail Haniyeh and Yahya Sinwar, for whom the Prosecutor had also requested warrants, his death has not yet been confirmed. Some interesting discussion on the duty of states and the question of head of state immunity - is it relevant? Perhaps Israel could stymie this by employing the complementarity principle and undertaking its own criminal process? What of universal jurisdiction under Geneva law? https://lnkd.in/eBkrKbJ9 #israel #gaza #warcrimes #icc #jurisdiction #complementarity #hamas #atrocity #hostages #starvation
