It promises to be a busy summer for the practitioners of data privacy. The Regulation on the Procedures and Principles Regarding the Transfer of Personal Data Abroad has been published in the Official Gazette of the Republic of Turkiye on 10 July 2024. This secondary legislation follows the amendments to Article 9 of the Law on the Protection of Personal Data that had entered into force last March. This was certainly one of the long-waited pieces of legislation in this field. On the same date as the publication of the regulation, the Personal Data Protection Authority has also published texts and guidelines for the Standard Contracts and binding coporate rules that it would consider as constituting an ‘appropriate safeguard’. The regulation aims to lay down the rules and principles that need to be followed while transferring personal data abroad. There are three broad grounds that may constitute a lawful basis for the transfer abroad: 1) Presence of An Adequacy Decision, i.e. a decision that shows that the data would enjoy an equivalent degree of protection in the jurisdiction it will be transferred to; 2) Alternatively, the presence of an appropriate safeguard, like a standard contract or binding corporate rules; 3) For incidental/ad hoc cases, explicit consent, or the presence of another ground listed under Article 9(6) of the Law on the Protection of Personal Data. These rules will have siginificant implications for all data controllers/processors who need to transfer that data abroad. While the regulation aims at eliminating the ambiguities that pervaded this field previously, there will most probably be new questions to be addressed in the new era too. Internal Seminar on the Draft Personal Data Protection Law Last Saturday, as per our internal training regime, PrivacyCompliance organized an internal seminar in Vietnamese where we reviewed the Draft Personal Data Protection Law ("Draft Law") and compared it to the current regulations. The seminar saw the participation of our staff and experts from multiple fields. We debated the implications of the various new provisions of the Draft Law.
