As LLM technology continues to advance, it's important for inventors and patent examiners to determine whether patent claims are drafted by human patent writers or generated solely by LLM models. US Patent Office has issued Inventorship Guidance for AI-Assisted Inventions, which guidance states, in part: "while AI-assisted inventions are not categorically unpatentable, the inventorship analysis should focus on human contributions, as patents function to incentivize and reward human ingenuity.
