Infrastructure Law Series #5 GNSS and its impact on BOT (toll) concessionaires: The Ministry of Road Transport and Highways (MoRTH) has amended the National Highways Fee (Determination of Rates and Collection) Rules, 2008, to introduce Global Navigation Satellite System (GNSS)-based tolling across India’s national highways, as notified in September 2024. The amendment provides for a satellite-based, pay-as-you-go system, allowing toll charges to be calculated by the actual distance traveled. Vehicles equipped with GNSS technology will benefit from a free allowance for the first 20 kilometers traveled, marking a significant shift from the current RFID-based FASTag model. For concessionaires operating under existing toll-based agreements, the transition to GNSS tolling raises essential questions. It remains to be seen how MoRTH and the National Highways Authority of India (NHAI) will address adjustments to existing contracts, especially if the new system impacts revenue expectations or changes traffic flow patterns. While this amendment may necessitate renegotiating revenue structures to align with distance-based billing, MoRTH has yet to release detailed guidance on whether contractual adjustments or compensation mechanisms will be offered to safeguard concessionaires’ interests.
