It is the first-ever international legally binding treaty aimed at ensuring that the use of AI systems is fully consistent with human rights, democracy and the rule of law. The Framework Convention was signed by Andorra, Georgia, Iceland, Norway, the Republic of Moldova, San Marino, the United Kingdom as well as Israel, the United States of America and the European Union. The treaty will enter into force on the first day of the month following the expiration of a period of three months after the date on which five signatories, including at least three Council of Europe member states, have ratified it. Today the Council of Europe Committee of Ministers adopted the first global #AITreaty. Its goal is to protect human rights, democracy and rule of law from the adverse effects of AI. ALLAI is honoured to have been involved in this process from the very beginning when Catelijne Muller advised the Council of European how to go about developing this treaty, and together with Jan Kleijssen joined the negotiations as formal Observer. The #AITreaty is open to ratification by countries from outside Europe as well and we urge the world to ratify. We also call upon all Council of Europe Member States to directly apply the treaty to private parties as they will have to do to public parties. (Yes, the AI Treaty covers both public and private actors, albeit with two ways to apply the treaty to the latter (in stead of one for public actors)). Ref. DC 193(2024) Council of Europe opens to signature first ever global treaty on AI Vilnius (Lithuania), 05.09.2024 – The Council of Europe Framework Convention on artificial intelligence and human rights, democracy, and the rule of law (CETS No. 225) was opened for signature today during a conference of Council of Europe Ministers of Justice in Vilnius. It is the first-ever international legally binding treaty aimed at ensuring that the use of AI systems is fully consistent with human rights, democracy and the rule of law. The Framework Convention was signed by Andorra, Georgia, Iceland, Norway, the Republic of Moldova, San Marino, the United Kingdom as well as Israel, the United States of America and the European Union. The treaty provides a legal framework covering the entire lifecycle of AI systems. It promotes AI progress and innovation, while managing the risks it may pose to human rights, democracy and the rule of law. To stand the test of time, it is technology-neutral. The Framework Convention was adopted by the Council of Europe Committee of Ministers on 17 May 2024. The 46 Council of Europe member states, the European Union and 11 non-member states (Argentina, Australia, Canada, Costa Rica, the Holy See, Israel, Japan, Mexico, Peru, the United States of America and Uruguay) negotiated the treaty. Representatives of the private sector, civil society and academia contributed as observers. It aims to ensure that activities within the lifecycle of artificial intelligence systems are fully consistent with human rights, democracy and the rule of law, while being conducive to technological progress and innovation. Going to be very interesting to see what kind of enforcement mechanisms exist in this global "AI" treaty, and what kind of actual teeth those have. There's a monitoring process and follow-up convening to assess whether member states are in compliance, but there's literally no mention [beyond what essentially reads as "we'll cross that bridge when we get to it"] as to what happens if they aren't. Like… what does it mean if a state joins these conventions, but then… doesn't uphold them? What happens if that state has like, just a bananas outsized amount of power on the global stage, especially when it comes to technosocial frameworks/contexts/paradigms? Can you think of any states like that? Any states that are joined to these conventions? Hm? Hm. Anyway. Gonna be interesting.

« This is why I will propose a new European Democracy Shield. As part of this, we will work to counter foreign information manipulation and interference online, building on the examples of Viginum in France or the Swedish Psychological Defence Agency. The aim is to increase situational awareness, by detecting, analysing and proactively, countering disinformation and information manipulation. We will focus on societal resilience and preparedness, through increased digital and media literacy and boosting prevention through pre-bunking. We will create a European network of fact-checkers and make it available in all languages. We will also continue to step up digital enforcement to ensure that manipulated or misleading information is detected, flagged and, where appropriate, removed in line with the Digital Services Act. Finally, we will also address the ever-more realistic deepfakes that have impacted elections across Europe. We will ensure that transparency requirements in the AI Act are implemented and that we strengthen our approach to AI-produced content. Its been more than 7 years that AI has become a policy priority at the EU level, resulting from decades of work at research level, following advancements of neural networks and breakthroughs in deep learning technological development, leading to questions of real impact on our lives and societies. Council of Europe has started very early within its CAHAI committee to reflect upon the impact that AI brings to human rights, democracy and rule of law. Following on CAHAI work it was clear that international framework was required, so new CAI committee has been tasked to prepare first international legaly binding convention that would set the international framework for countries to steer the development and use of AI towards democratic and human rights based way. Negotiations were not an easy task, including also many non-members of CoE with different national AI approaches and legal systems. One critical issue related for example to the question of scope, i.e. whether convention would not only cover government and public bodies but also private sector. At the end, this has been in large extent left to signimg parties to decide and declare when signimg the convention. Let's see how countries will decide.
🗓️Mark your calendars - 5/9/2024, Vilnius – Opening for signature : The Framework Convention on AI and Human Rights, Democracy and the Rule of Law of the Council of Europe The Convention on AI represents a landmark achievement of the Council of Europe, as the first-ever legally binding international treaty designed specifically to govern AI and guaranteeing respect for our fundamental rights and values. This pioneering agreement addresses all activities in the lifecycle of AI systems which may interfere with human rights, democracy and the rule of law. It also provides for efficient international cooperation between the Parties on this important matter. The Convention was adopted by the Committee of Ministers of the Council of Europe on 17 May 2024 in Strasbourg. On 5 September 2024 in Vilnius, it will be opened for signature under the Lithuanian Chairmanship of the Committee of Ministers of the Council of Europe. It will be a momentous step towards ensuring the responsible and ethical development of AI globally. Each state signing the treaty will contribute to a future where AI benefits all of humanity without compromising on our fundamental rights and values.
