Securing Evidence in the Digital Era: Anton Piller Orders vs Imaging Orders As digital data becomes central in litigation, traditional remedies like the Anton Piller, commonly known as a search order, while powerful it can be overly intrusive in the modern context. Courts have rightly grown cautious, requiring stringent safeguards due to the privacy implications of physically entering premises. A newer, more proportionate tool has emerged: the imaging order. Following the English decision in TBD (Owen Holland) Ltd v Simons [2020], English courts now permit court-appointed forensic IT experts to copy electronic data without physical intrusion, ensuring evidence is preserved while respecting privacy. 🖥️ Imaging orders reflect the digital reality of today’s disputes where key information resides on devices, in cloud accounts, or across platforms. It's time for Cypriot courts to follow suit.
