🔆 *BNSS, 2023 - Section 531 - "Repeal and Savings" - On a plain reading of section 531(2)(a) of the Bharatiya Nagarik Suraksha Sanhita 2023 (‘BNSS’), proceedings even for FIR Registered before 1 July 2024 are to be “… …disposed of, continued, held or made… …” in accordance with the Code of Criminal Procedure, 1973 only in cases where such proceedings, viz.“… …any appeal, application, trial, inquiry or investigation… …”, was pending immediately before the date on which the BNSS came into force, i.e. 01.07.2024. Support from central government, in the form of resources, legislation, and policy changes, would make a significant difference in the output and stability of #PRAP. The recent general election and formation of new government presents a possible turning point for #PRAP as highlighted in Independent Scrutiny & Oversight Board’s new report. The ISOB is calling on the new government to provide direct responsibility and funding to ensure the programme’s long-term success. As ISOB Chair Abimbola Johnson highlights, “Anti-racism cannot be achieved in a vacuum. If we want to divert the young and the vulnerable away from police intervention, other institutions need to be in the position to step in, and they, too, need to answer the call to become anti-racist to work together.
