VOSSIUS partner Dr. Marcus von Welser has written an article on the landmark decision of the Hamburg Regional Court. The court ruled that the copyright exception for text and data mining extends to downloading photos from the internet for AI training datasets (LG Hamburg, judgment of September 27, 2024, file number 310 O 227/23 - LAION). This is the first published judgment in the European Union dealing with the legal framework for the creation of AI training datasets. The battles over the use of copyrighted works to train generative #AI models are being fought largely in courts, where, at least in principle, there is statutory and case law judges can draw on to try to mediate the disputes. That leaves policymakers with breathing room to see how the courts come down before needing to legislate. In the case of #deepfakes and related issues around malicious disinformation using AI, however, the law is far less developed where it exists at all, making disputes difficult to litigate. Will AI Change with the Italian Text and Data Mining Copyright Exception? The Italian government is working on the first law to regulate artificial intelligence. This effort must operate within the scope of the upcoming EU AI Act, which as EU law, would prevail over national laws. One of the most controversial provisions of both the Italian AI law and the AI Act is the scope of the text and data mining exception. The AI Act contains a mere cross-reference to the relevant provision of the EU Copyright Directive, and the Italian AI law seems to go a bit further. The current draft provision (see 👇) refers more specifically to the modalities of implementing the opt-out mechanism by copyright holders, as well as to the disclosure obligations to which AI systems reproducing or extracting protected works are subject. In my view, there is some confusion about the concept of reproduction or extraction by AI systems during their training phase, and a clearer level of clarification would help copyright holders better understand how to exercise their opt-out rights and providers and deployers of AI systems to what the limit of their rights is. At DLA Piper, we are extensively working with both rights holders and companies exploiting AI to enable, on the one hand, the protection of their rights, and on the other, the maximization of AI's potential. The contribution from legal experts in drafting such laws might help legislators strike the right balance between contrasting interests that are likely to lead to major disputes, which might hinder the exploitation of AI's potential in the country.
