𝗟𝗮𝘀𝘁 𝘆𝗲𝗮𝗿'𝘀 𝘀𝗲𝗰𝗼𝗻𝗱 𝗳𝗮𝘃𝗼𝗿𝗶𝘁𝗲 𝗰𝗼𝘂𝗹𝗱 𝗯𝗲𝗰𝗼𝗺𝗲 𝘁𝗵𝗶𝘀 𝘆𝗲𝗮𝗿’𝘀 𝗳𝗮𝘃𝗼𝗿𝗶𝘁𝗲! The Propel Fuels v. Phillips 66 litigation was my second favorite trade secret dispute of last year (after only the game-changing Motorola v. Hytera. The court recently applied enhanced damages, bringing the damages from an already substantial $605M to an eye-watering $1.8B, just shy of the $2B Appian case (which was remanded on appeal). I am certain that Phillips 66 will appeal. It will be interesting to see what grounds for appeal they present, and if the case will ultimately be settled. 2025 is off to a rocket start in the trade secret arena.
