Minor privacy is back on the Congressional agenda this session with not one, but two major federal proposals that would alter how companies process minor data. While COPPA 2.0 is seen to be a more comprehensive approach to minor privacy in name and spirit, APRA’s approach to minor privacy has been seen by some as esoteric, requiring readers to journey through the labyrinth of definitions and interpret the cascading impact of APRAs treatment of sensitive data. In its current form, APRA appears to restrict advertising to minors in ways that would go far beyond the restrictions found in COPPA 2.0. What’s more, APRA’s restrictions on processing a minor’s data do not carry an explicit knowledge of standard in the public discussion draft. It’s dangerous to go alone!
