𝗛𝗼𝘄 𝗦𝗵𝗼𝘂𝗹𝗱 𝗪𝗲 𝗥𝗲𝗴𝘂𝗹𝗮𝘁𝗲 𝗚𝗲𝗻𝗲𝗿𝗮𝘁𝗶𝘃𝗲 𝗔𝗜 𝗶𝗻 𝗛𝗲𝗮𝗹𝘁𝗵𝗰𝗮𝗿𝗲? 🏥💡 As generative AI technologies like #ChatGPT and others rapidly advance, regulators face a unique challenge in adapting traditional frameworks for healthcare. Current FDA regulations, designed for specific drugs and devices, fall short when applied to AI models with vast and evolving capabilities. A novel approach is needed — one that treats these AI systems more like human clinicians, requiring rigorous training, supervision, and periodic reassessment. While challenges such as AI "hallucinations" and transparency in training data remain, a thoughtful regulatory framework can ensure these technologies safely enhance clinical practice. I was recently invited to deliver three keynotes during the 82nd International Pharmaceutical Federation (FIP) World Congress of Pharmacy and Pharmaceutical Sciences 2024 in Cape Town, South Africa from 1-4 September. During these sessions, I emphasized that we need a completely new approach and framework to regulate AI in healthcare — fully aligned with these insights. I’ve been given advice that the fastest way to monetize HER Heard without charging the end user (woman) is trackers and selling data. Instead, I’d like to build something more trustworthy. I don’t want to be in a headline like this. If you are not paying, then you are the product (you/your data are being sold). There are newer ways to deindentify data or even to aggregate things women search for that can be of interest to various stakeholders. In theory that could be okay to sell, but in a post-Roe world with laws encouraging bounty hunting, I am vetting the choices ahead. I am all for moving fast, without breaking things.

As #AI continues to transform healthcare, the potential for improved patient outcomes is immense. However, as expected, it's important to not forget concerns about potential bias or unfairness. Specifically, researchers from Stanford and Emory University argue that fairness must be context-specific and developed through collaboration. Efforts like the NIH’s AI/ML Consortium to Advance Health Equity and the WHO’s Global Initiative on AI for Health promote similar collaborations. Bakul Patel and David Blumenthal has an excellent take on a path forward for regulating generative AI applications in healthcare in their HBR article. "The way forward may involve conceiving of LLMs not as new devices but as novel forms of intelligence. Lest this seem totally bizarre, consider the following. Society has long experience with regulating human intelligence applied to health care for the purpose of assuring that humans are qualified to practice their professions. Physicians and nurses undergo elaborate training and testing before they are allowed to apply their skills. Practicing medicine without a license is a crime, and governments can revoke licenses when clinicians’ intelligence is compromised through illness or substance abuse. In the human case, the evolution of intelligence is not a problem but a benefit as clinicians learn from experience and from new scientific discoveries. Periodic recertification through testing is increasingly common for physicians who wish to be considered board certified in a particular specialty like cardiology or family practice." I am similarly anticipating this is how the regulatory landscape will shift to capture the rapidly evolving benefits of Gen AI in healthcare. In medical device risk management, there is a concept ALARP (As Low as reasonably practicable) that defines a tolerable risk if further risk reduction would be impractical. As the benefits of Gen AI applications grow, frameworks will need to change so we can practically experience the benefits. Our team is anticipating needing to be more transparent with our development process including architecture, data, process, risk management to accommodate this shift.

How long physicians have been in practice can signal burnout risk AI can significantly reduce the administrative burden on physicians by automating routine documentation tasks, providing decision support through predictive analytics, and streamlining clinical note creation and inbox message responses. This allows physicians to focus more on patient care. Ochsner Health also uses augmented intelligence (AI)—often called artificial intelligence—to help. Through a pilot program across its 46-hospital system, Ochsner Health uses generative AI listening tools to help reduce the administrative burden on physicians.In the program, physicians use ambient AI to listen while they converse more freely with patients during encounters and help produce clinical notes in the EHR for the physician to review, approve and sign.
