🏡 Real Estate Transfer Taxes in Massachusetts & Why They Are a Bad Idea... A few municipalities in Massachusetts could enact real estate transfer taxes. (Essentially, an additional percentage of the sale price, billed to the home seller and / or buyer by the town, upon sale of the property. The state already charges a Stamp Tax at $4.56 per thousand). The tax revenue for a municipal transfer tax is supposed to go toward the creation of deed restricted affordable units in that town... Read on... The Real Estate Market is already stunted by low inventory and high prices. An additional tax on homeowners and home buyers will have the following effects: 1. Hurts Down-sizers and Up-sizers: These taxes reduce the purchasing power of down-sizers (for example, retirees) and up-sizers (growing families) when they sell their homes. The proceeds from the sale diminish, affecting their ability to afford their next residence. 2. Hurts First-Time Buyers: By discouraging longtime owners from selling, transfer taxes decrease the available housing inventory. This scarcity makes it harder for first-time buyers to find suitable homes. Furthermore, if the town taxes the Buyer also, it just makes buying a home even more expensive than it already is. 3. Disincentivizes Developers: Developers may choose to hold onto condo units as high-priced rentals rather than sell them due to transfer taxes. This behavior limits the addition of much-needed housing supply to the market. 4. Disproportionately Impacts Lower-Income Sellers: Since transfer taxes are a flat rate on every sale, they disproportionately hit lower-income individuals who sell their properties. Higher-income sellers are less affected by this tax burden. 5. Existing Municipal Resources: Municipalities already have resources to address the housing crisis without relying on transfer taxes. These existing tools should be re-evaluated. Commercial development should be encouraged in municipalities to increase the tax base. This could create more funding for affordable units.
