Jacko Law Group Regulatory Tip of the Week by Michelle L. Jacko, CSCP Are You in Compliance with the California Consumer Privacy Act (CCPA)? Many businesses outside California may believe the CCPA does not apply to them, but it often does, especially for mid-size firms. The CCPA, effective January 1, 2020, enhances privacy rights and consumer protections for California residents. It applies to for-profit businesses that serve CA residents and either: • Have gross annual revenue over $25 million • Buy, sell, or share personal information of 100,000 or more CA residents • Derive 50% or more of annual revenue from selling CA residents’ personal information The CCPA requires businesses to inform CA consumers about collected personal data, its sale or disclosure, to limit the sale of personal data, and safeguard consumer rights, including protections against discrimination. In 2023, new protections were added, allowing consumers to correct inaccurate information and limit the use of sensitive data. Businesses must evaluate CCPA applicability and ensure proper disclosures via website links and other methods. A federal law requiring millions of businesses to disclose new information is approaching its first deadline. Amid lingering uncertainty over exemptions and definitions of beneficial ownership, California law firms still have much to unpack to help their clients navigate this new compliance burden. After taking effect this year, the first deadline for filing reports with FinCEN is Jan. 1, 2025. The arrival of the CTA heralds a new era for most private businesses — including law firms — which have historically not provided such information, so the new requirements could catch some off guard. Notably, beneficial owners can include general counsel, who are considered a senior officer of the company. Thus it’s both a new compliance issue for law firms and added responsibility for them to properly advise clients subject to the new regulation. Over 20 lawsuits have been filed concerning the injectable contraceptive Depo-Provera. Plaintiffs' attorney Ellen Relkin has requested the coordination of these cases in California. In a recent motion, Ellen Relkin proposed that the U.S. Judicial Panel on Multidistrict Litigation assign the lawsuits to U.S. District Judges William Orrick III or Jon Tigar in the Northern District of California. The majority of the plaintiffs are expected to be located in Massachusetts or California. These states have innovator liability laws that permit individuals to take legal action against the brand manufacturer Pfizer Inc., even if they used an unauthorized generic version of the drug. Additionally, there are authorized generic providers involved in the litigation. Ellen Relkin, representing Weitz & Luxenberg in New York, expressed confidence that there should be no preemption issue based on the U.S. Supreme Court's 2011 Mensing decision. She stated, “The authorized generic should not receive Mensing preemption protection,” in a statement to Law.com.
