Alternatively, you may use a third party service to vet your marketing claims. 🔹️You can't misrepresent the accuracy or reliability of your service, or what you have done to test or monitor it, or whether anyone providing a review has been compensated. 🔹️ You have to provide you customers disclosures re: known or reasonably knowable future harmful or potentially harmful uses or misuses of the product. These strings of letters don’t meet the basic definition of a trademark. A trademark must be used “to identify and distinguish” goods or services. These strings of letters are indistinguishable; they don’t aid the consumer in identifying a particular producer.

This is so disheartening! However, in addition to addressing this challenge, we need to find innovative ways to mobilize domestic capital and diaspora investments. The biggest challenge is “trust”, alot of our people work in silos with an individualistic mindset. We should learn from other races how to collaborate for greater impact! Ecosystems develop based trust! For instance, the Angel Investors and Venture Capitalists in Sillicone valley are within a tight network. And its trust that enables founders to tap into these networks/relationships to raise preseed, seed capital, and later funding rounds. Even in Nigeria the Igbo entrepreneurship and trans-generational wealth creation model is based on trust.

The House Subcommittee on Innovation, Data, and Commerce has approved a major overhaul of the American Privacy Rights Act (APRA) This draft bill aims to: Strengthen data privacy protections for consumers by placing stricter limits on how businesses collect, store, and use personal information. Update the Children's Online Privacy Protection Act (COPPA) to further safeguard children's data online. Empower teenagers with a "digital marketing bill of rights" and establish a Youth Marketing and Privacy division within the FTC. Streamline data transfers for research purposes while maintaining privacy safeguards. Increase oversight of algorithms by tasking the National Telecommunications and Information Administration (NTIA) and independent auditors with evaluating their impact on data privacy. Yesterday, Maryland became the 17th state to enact a comprehensive data privacy statute. With more than 40% of the U.S. population residing in those states, the patchwork of data privacy laws in the U.S. has created significant legal challenges for companies doing business nationwide. However, with Congress taking up the new American Privacy Rights Act (APRA), those challenges may soon abate. Drawing on data privacy and protection concepts from international regulations and state comprehensive data privacy laws, the APRA creates a unique law that attempts to address contemporary privacy concerns while simultaneously anticipating future technologies. What a set back for Mexico if the data protection authority is dissolved! INAI has been a key partner for data protection authorities around the world at the Global Privacy Assembly and beyond. Effective data protection is critical to cross border trade and of course to local human rights and economy. Sharing a link to IAM's article by Angela Morris on the impact of the USPTO's latest data breach. IAM's sister platform World Trademark Review reported that "repeated data exposures create serious concerns about the USPTO's ability to protect sensitive data." I was quoted as saying "it goes to show that America's innovation agency does not have all their ducks in a row with regard to the way that they are managing confidential patent application filings, and this is a huge concern. We need to know that we have an agency that is following the rules and that has the IT set-up to follow those rules." TT Consultants's Stephen Gucker and McCabe & Ali LLP's Emil Ali were also quoted in the article. Read patent examiners reactions to Congress's call for Kathi Vidal, Under Secretary of Commerce for Intellectual Property to investigate those reddit comments. I imagine USPTO management will respond to Congress by rounding up the usual suspects and deny any responsibility for patent examiners' and patent applicants' pressing concerns. "This is undoubtedly a bad look for the office. That being said, think for a minute about the typical content of this subreddit: obscenely high attrition rates; millions of dollars wasted hiring and firing examiners nonfunctional IT systems and resulting wage theft by management a broken docketing system that assigns applications to examiners who are not qualified to examine them examiners not being given enough time to properly examine applications. Earlier today, the California Privacy Protection Agency Board voted to advance the new draft CCPA regulations to formal rulemaking. We thought it might be helpful to provide a series of short high-level summary webinars on the new rulemaking topics, starting with automated decisionmaking technology (ADMT). If you missed the Board meeting, the draft ADMT rules were a source of many comments and concerns, including their impact on artificial intelligence. Thanks Chinenye. I couldn't agree with you more. However while we work on this, we also have to be mindful of the fact that bias isn't just the problem in this data rather a combination of poor economy and bias. Of all these regions mentioned, Africa is the least performing market. therefore Davidson, naturally you would expect investors to do less there. They are not charity organisations but a venture set up for outsized returns.Therefore the major issue we should be discussing is, which sectors are receiving this funding in Africa? Are the investments coming to sectors that will lift the other sectors up fundamentally or to sectors that will window dress the issues? or Worst still the ones that will reap-off on the people and distort rather than disrupt the system. (eg Nigeria POS fintech and the real banking system. a discussion for another day). Until strong investments are made in the technology sectors powering manufacturing strong job growth in Africa be it REAL B2B eCommerce not repeating what is already being done, or B2C eCommerce that is truly efficient and cost effective. Equally important is the improvement in the purchasing power of the consumers via credit card system. in as much as Sub-Sahara Africa lacks good credit system that captures the average citizens and residents, B2C will continue to struggle. in as much as our logistics investments are predominantly in the last mile delivery rather than efficient crosborder logistics, both B2B abd B2C eCommerce will struggle to scale efficiently and profitability. So, it's time for the investors to do away with the low hanging fruits and start tackling the real issues that will empower and propel Africa economies. That's where the main bias lies.

This week we venture into the world of patent monetization from the viewpoint of a patent owner and non-practicing entity. Our conversation is with Brad Close, a one-time patent prosecution attorney, one-time patent broker, and current patent owner engaged in patent monetization efforts, licensing and, of course, litigation.  We start our conversation addressing life as an NPE, and the arguments that are often made against NPEs owning and enforcing patents.
