From Lippes Mathias LLP: New York State recently enacted a new Article 44-A of the New York State General Business Law, known as the “Freelance Isn’t Free Act” (“Act”). Once it goes into effect on August 28, 2024, the Act will require individuals and entities who engage individual or single owner entity independent contractors to, among other things, enter into a written contract with those independent contractors (the agreement can be provided physically or electronically to the independent contractor), and thereafter provide timely payment to those independent contractors for their services. #independentcontractors #newyork #statelaw

From two New York-based offices in 2008, we had expanded into additional offices in Miami, Fort Lauderdale, West Palm Beach, Philadelphia, Boston, Hartford, New Haven, Los Angeles, San Francisco, and Irvine by the end of 2010. We went from two offices to 10 and roughly 450 people to 900, practically overnight. Marcum LLP's evolution continued. There became three prongs to our M&A strategy: geographic expansion into new markets, tuck-ins into existing offices, and sector-based expansion in our clients’ major industry groups. Our strategic plans NEVER had numbers associated with them. We NEVER focused on a dollar amount by which to increase revenue. We NEVER focused on how much our profitability would increase. RPJ Partner Alice Jump Featured in Morningstar Article “Can a Felon Get a Commercial Real-Estate Loan?” Following former President Donald Trump’s 34 criminal convictions in New York, questions surrounding the future of Trump’s real-estate business in relation to his newfound felony status have arisen. Financing is crucial to Trump’s commercial real-estate business, and yet his ability to secure any future loans may be at risk due to his recent felony conviction. Jump, however, contends that as a general matter, banks and lenders would still be able to provide loans to Trump should they wish to do so. According to Jump, while “[i]t's certainly not going to help… [t]here is no blanket prohibition” on a convicted felon applying for or receiving a new property loan. Jump furthermore notes that in the employment context at least “New York has considered a criminal history to be a protected category,” and as a result Trump may stand to benefit from the very state criminal justice reform he has opposed politically. In mid-November, Enviva, the world’s largest wood pellet producer with headquarters in Bethesda (USA), successfully emerged from restructuring proceedings under Chapter 11 of the U.S. Bankruptcy Code. As part of its financial restructuring, Enviva has equitized more than US-$1 billion of indebtedness.
