Attorney Jennifer Cox from COX & OSOWIECKI LLC presented "Changes in HIPAA Privacy Rules & Intersection of HIPAA Privacy Risks with 42 CFR Part 2 Rule Update" at the Annual Compliance and Internal Audit Conference presented by NEHIA and HFMA MA-RI. She was introduced by past NEHIA President Donna Schneider, RN, MBA, CPC-P, CHC, CCEP, CHPC, CHRC. Attorney Cox's presentation explored recent, significant regulatory changes to the federal law governing the confidentiality of substance use disorder treatment records (42 CFR part 2) with a focus on corresponding HIPAA rule changes. Healthcare providers will be expected to learn, implement and train staff to follow the new rules no later than February 2026. The rules are intricate and will require major shifts in approach for consents and information exchange, as well as entirely new policies, forms, and updates to HIPAA business associate agreements. The rule will affect all providers, not just those who specialize in SUD treatment, because even a history of SUD or SUD treatment can affect how certain records must be handled. Jennifer also took questions on the new reproductive health rules that came out in April and are effective December 23rd. They may be short-lived given the political environment, but compliance professionals should be on alert for state actions that may accomplish the same objectives. Adding Third-Party risk posture assessment to the mix completes the circle. Regardless of SaaS / Subscription, Outsourcing, or Perpetual licensing, processing / handling PHI and other data requires security controls to not only be in place but executed and monitored regularly. Understanding where the third-parties are on the maturity scale along with the gaps in their information security program allows proper mitigation, assignment, or acceptance of the risks. Emory Healthcare has successfully implemented Switchboard, MD's MDAware Inbox Management solution, enhancing communication and operational efficiency for staff and clinicians across four specialty clinics. This week Microsoft released Digital Defense 2024 report that has some great information on the cyber threats not only from bad actors but also from nation-state actors. One interesting finding was that education and research was second most targeted group by these bad actors. This is not really very surprising as we know that Universities and Research labs are where future policies, far out technologies like Quantum computing, cryptography, new rna based treatments are being developed. Universities and research also encourage cooperation and openness since many times it is incremental work that is being done on the foundations of previous generations work. This culture of openness also leads to lax enforcements of security standards or access controls. Many of these nation-state actors are after the policy positions of the US govt or new technologies to exploit. Additional insights from the report are that in the past year 775 million messages contained malware. This paper addresses real-world implementation challenges and benefits of Federated Learning in radiology, proposing a comprehensive guide for deploying FL in clinical practice. 1️⃣ The study highlights FL's ability to train collaborative DL models without sharing sensitive data, making it suitable for regulatory compliance (e.g., GDPR, HIPAA) in medical imaging. 2️⃣ A practical FL framework was implemented within the German RACOON initiative, involving six university hospitals, to train DL models for lung pathology segmentation across diverse datasets. 3️⃣ Major challenges identified include organizational hurdles, legal complexities, infrastructure limitations, data heterogeneity, and evaluation difficulties in real-world FL settings. 4️⃣ The authors propose solutions such as standardizing data specifications, incentivizing site participation, deploying offline-installable FL platforms, and using automated data validation tools. 5️⃣ Experimental results show that FL models, particularly specialized ones, consistently outperform local and ensemble approaches in segmentation tasks, proving FL's robustness and utility despite high heterogeneity. 6️⃣ The proposed guide categorizes FL challenges into "practical hurdles" (solvable with technical/legal measures) and "inherent difficulties" (requiring acknowledgment in FL design). 7️⃣ The study emphasizes the scalability and clinical impact of FL for advancing radiological research while providing detailed guidance to streamline future FL initiatives. ✍🏻 Markus Bujotzek, Ünal Akünal, Stefan Denner, Peter Neher, Maximilian Z., Eric Frodl, Astha Jaiswal, Moon Kim, Nicolai Krekiehn, Manuel Nickel, Richard Ruppel, Marcus Both, Felix Dollinger, PD Dr. med. Thought I’d share my recent testimony before the Montgomery County, Maryland Board of Ed (BoE) – the largest school district in MD (composed of over 160K students). We’ve been pushing to form a privacy advisory group for the County, composed of privacy and cybersec experts (parents, teachers, citizens) to help the school district supplement its privacy expertise (since there is little dedicated privacy expertise at the present). I’m hopeful that as part of its work, this Group could potentially look at reducing the number of EdTech providers used by the District, conduct the first ever audits of EdTech firms, to see if they are (or are not) adhering to their contractual obligations and FERPA obligations, provide advisory opinions on important student data privacy issues (e.g., use of tech that monitors or surveils students), etc. Anyway, sharing the written testimony if helpful to others - as well as a short 2-minute clip of my testimony - in the hopes others can benefit from this and perhaps even use for their efforts. The good news is that a number of BoE members appear to be favorable to this proposal, so momentum seems to be building. This pro-tip for enhancing your development flow with AI was shared with me today by one of our incredible Cooperative Benefits Group (CBG) Staff Architects (Spencer Judd). Using Anthropic's Claude 3.5 Sonnet (or your favorite model), do the following flow: 1. Enter the following prompt: You are a prompt writing expert; I want to write some expert level prompts for: [enter your use case here. in our case, Software Development]. I need some for reviewing code, providing feedback, identifying patterns, testability, well architected solutions, security, performing WAR sessions, and monitoring services in production. 2. Then it gives you some short but good ones in a list. In that same chat, tell it to go one by one and make each prompt an expert level prompt. 3. Then it gives you some expert level prompts in another list. Bookmark or save these somewhere to use with other LLMs! 4. But this is how you level-up the flow even further. Once you have that list of expert level prompts, in that same chat enter the following: Now take all of those expert level prompts that you generated and make them into a perfect system prompt that is capable of executing all of the tasks associated with those expert level prompts. 5.
