Today, let’s dive back into discussion on New York’s energy policy and touch on some positive news out of Albany, which is that the Affordable Gas Transition Act and the NY HEAT Act were not included in the final 2025 New York State budget that was passed on April 19. However, the legislative session will continue through June 6, and there is still work to be done. Your voice is more important now than ever, as Governor Hochul and Albany elected officials to continue to debate policies that could have a serious impact on how Western New Yorkers live, how our businesses operate, and the affordability and reliability of our energy sources. An article published this week by the Times Union discussed some of the items that didn’t make it into the budget but are expected to be debated on through the remainder of this legislative session, including the NY HEAT Act, which would get rid of the “100-foot rule,” limit utilities’ “obligation to serve” and provide the NY Public Service Commission (a state agency) the power to curtail portions of the gas system. As New Yorkers, particularly Western New Yorkers who endure regular chilling temperatures and substantial winter snowfall annually, we should continue to express our concerns to policymakers about the importance of energy affordability, choice, reliability and resiliency. Our State should be considering energy policies that balance these key elements while responsibly incorporating emissions reductions options. This should be a great day spent with leaders in the transportation decarbonization space. The day before the summit, November 13, National Grid will file our ‘Urgent Projects’ Filing in the NY PSC’s Proactive Planning Proceeding. At this summit on November 14, I will describe our filing and projects. Our team spent years building a forecasting and project prioritization methodology that aligns the interests of ratepayers, developers, policy makers, and…maybe, dare I say, even naysayers. National Grid’s projects represent a watershed moment in utility planning: we seek to accommodate explosive load growth through area planning that’s comprehensive and coordinated. Enough of the the whack-a-mole approach we’ve historically taken - let’s induce load where it saves all customers money. See you next week!

The New York State Department of Public Service released the Clean Energy Standard Biennial Review Report in Case 15-E-0302 on Monday outlining the state's progress towards its 70 by 30 goal as set forth in the Climate Leadership and Community Protection Act of 2019. As the report indicates, the state's ambitious goal of 70% renewable generation by 2030 is in jeopardy. At the end of 2022, NYS produced only 25% of its generation from renewable sources. It is time to reconvene all stakeholders to examine all available options and all sources of capital in order to close this enormous gap.

In addition to safely and reliably distributing natural gas to more than 2.1 million people throughout Western New York and Northwest Pennsylvania, National Fuel is also committed to being a cost-effective energy source for consumers. Within the Utility’s New York and Pennsylvania service territories, the Company provides natural gas service to approximately 93% and 84% of households, respectively. In New York and Pennsylvania, 83% and 73% of our Utility customers, in turn, use natural gas for heating. With the poverty rates in our areas being above the national average, it is important to remember that natural gas has consistently ranked as our service territories’ most affordable energy source. A cost-effective energy solution, natural gas is 3-4.5 times less expensive than electricity, and has a delivery reliability rate of more than 99.99%, helping families and businesses keep the natural gas and heat flowing, even during cold winter temperatures and severe weather events. The Company strives to maintain affordable delivery rates while limiting the frequency of requested delivery rate increases. Through effective management of our utility systems, National Fuel has been able to limit the occurrence of delivery rate increases. A study published by the Energy Information Administration demonstrated that in 2022, the Utility had the lowest residential delivery rate in New York and Pennsylvania and the second and third most affordable total bills, respectively, in the entire northeastern United States. Through various payment assistance programs, the Company has additional ways to help customers who may be struggling to pay their natural gas bills. In addition to state and federally funded programs and initiatives, National Fuel offers budget and deferred payment plans to stabilize customer bills, encourage timely payments and assist with maintaining uninterrupted service. Our Customer Service Team is able to connect eligible customers to programs and resources that may ultimately make their natural gas bills affordable, despite their financial circumstances. Customers are always encouraged to contact National Fuel if they struggle with their bill to see for which programs they may qualify. National Fuel has a strong history of delivering safe, reliable and affordable natural gas to customers, and that mission will remain at the forefront of all that we do. This article discussion flies in the face of the market PJM has created. A market that only supports short term assets like wind and solar backed up by gas or batteries. In short it confirms the market flaws that have been claimed by utilities over many years, and should encourage support for creating market signals to create long lived assets like baseload generation plants.
