Important issues for oil and gas well operators: In a Nov. 14, 2024, opinion in Romeo v. Antero Resources Corp., the Supreme Court of Appeals of West Virginia found that oil and gas operators must bear postproduction expenses associated with producing, transporting, and marketing residual gas and natural gas liquids (#NGLs) up to the point of sale unless the lease expressly provides otherwise. In doing so, the court placed West Virginia in a “minority of one” and recognized that West Virginia law obligates operators to bear postproduction costs further downstream than other jurisdictions. On Nov. 1, 2024, the Centers for Medicare & Medicaid Services issued a final rule that will increase payments to end-stage renal disease (ESRD) facilities in calendar year 2025. McCool, a former federal prosecutor and a fellow of the American College of Trial Lawyers, has served as lead counsel in more than 75 criminal and civil jury and bench trials. Last year, he and Coleman led a team that obtained a full acquittal following an eight-week jury trial for a senior international broadcasting executive charged in the FIFA bribery case in the Eastern District of New York. “Steve is the consummate trial lawyer, respected for his ability to guide clients through complex prosecutions and investigations,” said Noreen Kelly, McGuireWoods’ deputy managing partner for litigation. “Julia is a rising star whose skill and insight complement Steve’s strengths. On Nov. 13, 2024, in Gregg v. Central Transport LLC, the U.S. District Court for the Northern District of Illinois confirmed that Public Act 103-0769, which amends Illinois’ #Biometric Information Privacy Act (BIPA), has retroactive effect. This decision favorably addresses a critical issue for Illinois employers defending BIPA claims in which the alleged violations pre-date the August 2024 amendment. A McGuireWoods LLP trial team proved to a federal jury on Nov. 19 that an online retailer and manufacturer infringed Penn State University’s #trademarks by selling unlicensed merchandise with names and vintage images associated with the university. The closely watched case has significant implications for colleges and universities that license their trademarks to third parties.
