Writing for The Legal Intelligencer, Andrew Kassner and Joseph Argentina authored an article analyzing a decision by a Massachusetts bankruptcy court. According to the court, a lender has the right to request changes to a mortgage under a Chapter 11 bankruptcy plan — even if the person filing for bankruptcy isn't the one who owes the mortgage. However, the court limited the ability to “cram down” the plan terms against the lender to the extent it modified the lender’s rights against the nondebtor obligor.

Internal Revenue Code Section 83(b) elections can now be made on a standard IRS Form 15620. Previously, 83(b) elections were made on self-drafted forms. In a decision with far-reaching impact, a Texas federal court struck down the Department of Labor’s 2024 rule raising the overtime exemption salary threshold. Now, the 2019 salary thresholds for EAP employees are in effect again. Employers no longer need to plan for the additional automatic salary threshold increase that was scheduled for January 1, 2025. They also are no longer required to adhere to the previous increase that went into effect on July 1, 2024.
