Last week, Elsberg Baker & Maruri PLLC partner David Elsberg was interviewed in the Law, disrupted podcast, hosted by John Quinn. The two former colleagues discussed starting a new firm and recruiting top-tier associates.     When asked what prompted Elsberg to launch the firm with Rollo Baker and Silpa Maruri, he cited the opportunity to work with great lawyers as a key driver. “It was the idea of building something from the bottom up that I thought could be very satisfying, and also a stretch. Bloomberg Law recently spoke to Elsberg Baker & Maruri PLLC’s David Elsberg about the firm’s recent spate of associate applications amidst a presidential hiring freeze on federal agencies. “We do a lot of trials and we give early experience and a lot of them are interested in trial work,” David Elsberg said. “It’s sort of a really good match for us, which is also why we’ve been seeing a lot of applications come in.” EBM expects to make offers to students who have had federal offers rescinded for the firm’s 2025 summer associate pool and its new associate class. Law360 recently reported on the New York state appellate court affirming a victory that Elsberg Baker & Maruri PLLC won on behalf of its client Sol Goldman Investments, LLC. (“SGI”), dismissing claims against SGI alleging that it breached contract provisions governing an appraisal and put-right process in a $2 billion dispute over a real estate empire in a case the press has called a “real life Succession.” 𝘓𝘢𝘸360 reported that the appellate court ruled that “SGI is not a party to its own operating agreement … dooming breach of contract and related claims” and the article quoted the portion of the appellate court decision stating that "[c]ontrary to plaintiffs' assertion, the fact that defendant LLC was managed, opened bank accounts, or otherwise was operated in accordance with the operating agreement does not stop it from claiming that it is not bound by that agreement." The Appellate Division, First Department, affirmed Elsberg Baker & Maruri PLLC's victory on behalf of its client, Sol Goldman Investments, LLC (“SGI”), in a dispute over a multi-billion-dollar real estate empire. The appellate court ruled that SGI could not be held liable for allegedly breaching provisions in the company’s LLC agreement governing a put-right process that resulted in a valuation of the company that allegedly was more than half-a-billion dollars lower than it should have been.
